  1.1                          A bill for an act 
  1.2             relating to motor vehicles; clarifying power to 
  1.3             appoint motor vehicle deputy registrars; amending 
  1.4             Minnesota Statutes 1994, section 373.35, subdivision 1.
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1994, section 373.35, 
  1.7   subdivision 1, is amended to read: 
  1.8      Subdivision 1.  The county auditor shall serve as the 
  1.9   director of the county license bureau or, if the auditor chooses 
  1.10  not to serve, the county board shall appoint any other county 
  1.11  officer or employee, or any other person, to serve as the 
  1.12  director upon the terms and conditions the county board deems 
  1.13  advisable.  The county board shall set the compensation of the 
  1.14  director and may provide for the expenses of the office 
  1.15  including the premium of any bond required to be furnished by 
  1.16  the director.  The director shall have the powers and duties 
  1.17  imposed on the county officer who previously had the authority 
  1.18  to issue or process the application for any license referred to 
  1.19  in section 373.32. 
  1.20     Notwithstanding section 168.33, subdivision 2, the 
  1.21  commissioner of public safety may appoint, and for cause 
  1.22  discontinue, the director as the deputy registrar of motor 
  1.23  vehicles in the county.  If appointed a deputy registrar the 
  1.24  director shall have the same authority as a county auditor to 
  1.25  appoint one or more deputy registrars as provided in section 
  2.1   168.33, subdivision 2.  If the director is a deputy registrar, 
  2.2   all provisions of section 168.33 and Minnesota Rules, chapter 
  2.3   7406, apply to a county license bureau.
