  1.1                          A bill for an act 
  1.2             relating to education; modifying requirements for 
  1.3             certain English as a second language programs; 
  1.4             amending Minnesota Statutes 1998, sections 124D.52, by 
  1.5             adding a subdivision; and 124D.53, subdivision 2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 124D.52, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 4.  [ENGLISH AS A SECOND LANGUAGE PROGRAMS.] The 
  1.10  commissioner shall approve an adult basic education program 
  1.11  under this section that provides English as a second language 
  1.12  instruction if the persons providing the English as a second 
  1.13  language instruction meet the requirements of section 122A.19, 
  1.14  subdivision 1, clause (a), regardless of whether the persons 
  1.15  providing that instruction hold teachers licenses. 
  1.16     Sec. 2.  Minnesota Statutes 1998, section 124D.53, 
  1.17  subdivision 2, is amended to read: 
  1.18     Subd. 2.  [PROGRAMS FUNDED.] Adult basic education programs 
  1.19  established under section 124D.52 and approved by the 
  1.20  commissioner, including programs that meet the requirements of 
  1.21  section 124D.52, subdivision 4, are eligible for revenue under 
  1.22  this section.
