  1.1                          A bill for an act 
  1.2             relating to game and fish; combining firearms and 
  1.3             archery licenses to take deer; authorizing taking of 
  1.4             one deer by each method; amending Minnesota Statutes 
  1.5             1994, sections 97A.475, subdivisions 2 and 3; and 
  1.6             97B.301, subdivisions 1, 3, 4, 5, and by adding a 
  1.7             subdivision; repealing Minnesota Statutes 1994, 
  1.8             section 97B.301, subdivision 2. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1994, section 97A.475, 
  1.11  subdivision 2, is amended to read: 
  1.12     Subd. 2.  [RESIDENT HUNTING.] Fees for the following 
  1.13  licenses, to be issued to residents only, are: 
  1.14     (1) for persons under age 65 to take small game, $10; 
  1.15     (2) for persons age 65 or over, $5; 
  1.16     (3) to take turkey, $16; 
  1.17     (4) to take deer with firearms, $22; 
  1.18     (5) to take one deer by firearms and one by archery, $22; 
  1.19     (6) (5) to take moose, for a party of not more than six 
  1.20  persons, $275; 
  1.21     (7) (6) to take bear, $33; 
  1.22     (8) (7) to take elk, for a party of not more than two 
  1.23  persons, $220; and 
  1.24     (9) (8) to take antlered deer in more than one zone, $44.  
  1.25     Sec. 2.  Minnesota Statutes 1994, section 97A.475, 
  1.26  subdivision 3, is amended to read: 
  1.27     Subd. 3.  [NONRESIDENT HUNTING.] Fees for the following 
  2.1   licenses, to be issued to nonresidents, are: 
  2.2      (1) to take small game, $56; 
  2.3      (2) to take deer with firearms, $110; 
  2.4      (3) to take one deer by firearms and one by archery, $110; 
  2.5      (4) (3) to take bear, $165; 
  2.6      (5) (4) to take turkey, $56; 
  2.7      (6) (5) to take raccoon, bobcat, fox, coyote, or lynx, 
  2.8   $137.50; and 
  2.9      (7) (6) to take antlered deer in more than one zone, $220. 
  2.10     Sec. 3.  Minnesota Statutes 1994, section 97B.301, 
  2.11  subdivision 1, is amended to read: 
  2.12     Subdivision 1.  [LICENSES REQUIRED.] A person may not take 
  2.13  deer without a license.  A person must have a firearms deer 
  2.14  license to take deer with firearms and an archery deer license 
  2.15  to take deer by archery except as provided in this section.  
  2.16     Sec. 4.  Minnesota Statutes 1994, section 97B.301, 
  2.17  subdivision 3, is amended to read: 
  2.18     Subd. 3.  [PARTY HUNTING.] If two or more persons with 
  2.19  licenses to take deer by firearms, or two or more persons with 
  2.20  licenses to take deer by archery, are hunting as a party, a 
  2.21  member of the party may take more than one deer by firearms or 
  2.22  by archery, but the total number of deer taken by the party by 
  2.23  each method may not exceed the number of persons licensed to 
  2.24  take deer in the party.  
  2.25     Sec. 5.  Minnesota Statutes 1994, section 97B.301, 
  2.26  subdivision 4, is amended to read: 
  2.27     Subd. 4.  [TAKING MORE THAN ONE DEER.] The commissioner 
  2.28  may, by rule, allow a person to take more than one deer by 
  2.29  firearms or more than one deer by archery.  The commissioner 
  2.30  shall prescribe the conditions for taking the additional deer 
  2.31  including:  
  2.32     (1) taking by firearm or archery; 
  2.33     (2) obtaining additional licenses; and 
  2.34     (3) payment of a fee not more than the fee for a firearms 
  2.35  deer license; and 
  2.36     (4) the total number of deer that an individual may take. 
  3.1      Sec. 6.  Minnesota Statutes 1994, section 97B.301, 
  3.2   subdivision 5, is amended to read: 
  3.3      Subd. 5.  [FAMILY HUNTING LICENSE.] A resident family 
  3.4   license may be issued by the commissioner.  "Family" is defined 
  3.5   as a husband, wife, and their children under the age of 18 
  3.6   residing at home.  To hunt with a family license, children must 
  3.7   be under the age of 18 and enrolled in school.  The individual 
  3.8   deer limits in subdivision 1 do not apply to the family license. 
  3.9   When hunting with a family license, the total limit for the 
  3.10  license is one per family member by firearms and one per family 
  3.11  member by archery, not to exceed four a total of eight deer.  
  3.12     Sec. 7.  Minnesota Statutes 1994, section 97B.301, is 
  3.13  amended by adding a subdivision to read: 
  3.14     Subd. 7.  [EFFECT OF SINGLE LICENSE.] A license to take 
  3.15  deer by firearms and by archery authorizes the taking of one 
  3.16  deer by each method.  A licensee must comply with all laws and 
  3.17  rules of the commissioner governing the method used to take each 
  3.18  deer. 
  3.19     Sec. 8.  [REPEALER.] 
  3.20     Minnesota Statutes 1994, section 97B.301, subdivision 2, is 
  3.21  repealed.
