  1.1                          A bill for an act
  1.2             relating to human services; modifying certain asset 
  1.3             and income requirements for medical assistance; 
  1.4             modifying the verification requirements for Minnesota 
  1.5             supplemental aid; amending Minnesota Statutes 1994, 
  1.6             sections 256B.056, by adding subdivisions; and 
  1.7             256D.405, by adding a subdivision; repealing Minnesota 
  1.8             Statutes 1994, section 256D.425, subdivision 3. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1994, section 256B.056, is 
  1.11  amended by adding a subdivision to read: 
  1.12     Subd. 4a.  [ASSET VERIFICATION.] For purposes of 
  1.13  verification, the value of a life estate shall be considered not 
  1.14  saleable unless the owner of the remainder interest intends to 
  1.15  purchase the life estate, or the owner of the life estate and 
  1.16  the owner of the remainder sell the entire property. 
  1.17     Sec. 2.  Minnesota Statutes 1994, section 256B.056, is 
  1.18  amended by adding a subdivision to read: 
  1.19     Subd. 4b.  [INCOME VERIFICATION.] The local agency shall 
  1.20  not require a monthly income verification form for a recipient 
  1.21  who is a resident of a long-term care facility and who has 
  1.22  monthly earned income of $80 or less. 
  1.23     Sec. 3.  Minnesota Statutes 1994, section 256B.056, is 
  1.24  amended by adding a subdivision to read: 
  1.25     Subd. 5a.  [INDIVIDUALS ON FIXED INCOME.] Recipients of 
  1.26  medical assistance who receive only fixed unearned income, where 
  1.27  such income is unvarying in amount and timing of receipt 
  2.1   throughout the year, shall report and verify their income 
  2.2   annually. 
  2.3      Sec. 4.  Minnesota Statutes 1994, section 256B.056, is 
  2.4   amended by adding a subdivision to read: 
  2.5      Subd. 5b.  [INDIVIDUALS WITH LOW INCOME.] Recipients of 
  2.6   medical assistance not residing in a long-term care facility who 
  2.7   have slightly fluctuating income which is below the medical 
  2.8   assistance income limit shall report and verify their income on 
  2.9   a semiannual basis. 
  2.10     Sec. 5.  Minnesota Statutes 1994, section 256D.405, is 
  2.11  amended by adding a subdivision to read: 
  2.12     Subd. 1a.  [EXEMPTION.] Recipients who maintain 
  2.13  supplemental security income eligibility are exempt from the 
  2.14  reporting requirements of subdivision 1, except that the 
  2.15  policies and procedures of transfers of assets are those used by 
  2.16  the medical assistance program under section 256B.0595. 
  2.17     Sec. 6.  [REPEALER.] 
  2.18     Minnesota Statutes 1994, section 256D.425, subdivision 3, 
  2.19  is repealed.  
  2.20     Sec. 7.  [EFFECTIVE DATE.] 
  2.21     Sections 1 to 6 are effective August 1, 1995.
