A bill for an act
relating to motor vehicles; establishing a special Pedal Minnesota license plate;
providing for bicycle safety donations and grants; requiring reports; amending
Minnesota Statutes 2012, sections 168.013, subdivision 22; 168.1293, by adding
subdivisions; proposing coding for new law in Minnesota Statutes, chapters
168; 174.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1.
Minnesota Statutes 2012, section 168.013, subdivision 22, is amended to read:
Subd. 22.

Minnesota Statutes 2012, section 168.1293, is amended by adding a subdivision
to read:

of each type of special plate issued under this chapter.

(a) By November 15 of each year, the commissioner
shall submit a report on special plates to the chairs and ranking minority members of the
legislative committees with jurisdiction over transportation policy and finance.

(b) The report must, at a minimum, specify:

(1) for each type of special plate issued under this chapter, the number issued in the
last previous fiscal year and since inception of the plate; and

(2) for each type of special plate that requires an additional contribution under
this chapter, the amount of contribution funds received in the last previous fiscal year
and since inception of the plate, and a brief description of the primary expenditures and
usage of contribution funds.

(c) Any department or agency receiving contribution funds in association with
special plates shall assist the commissioner, as requested, in preparing the report required
by this subdivision.

Sec. 4.

[168.1299] SPECIAL PEDAL MINNESOTA PLATES.

The commissioner shall issue special Pedal Minnesota
plates, or a single motorcycle plate, to an applicant who:

(1) is a registered owner of a passenger automobile, one-ton pickup truck,
motorcycle, or recreational motor vehicle;

new text begin
(2) pays a fee of $10 for each set of plates, along with any other fees required by
this chapter;
new text end
new text begin
(3) pays the registration tax as required under section 168.013;
new text end
new text begin
(4) complies with this chapter and rules governing registration of motor vehicles; and
new text end
new text begin
(5) makes an annual contribution of at least $30 to the bicycle safety and information
account.

After consultation with interested groups, the commissioner shall
design the special plate to contain the inscription "Pedal Minnesota."

On application to the commissioner and payment of a
transfer fee of $5, the registered owner of a vehicle bearing the special plates may transfer
the plates to another motor vehicle if the subsequent vehicle is:

(1) qualified under subdivision 1, clause (1), to bear the special plates; and
new text end
new text begin
(2) registered to the same individual to whom the special plates were originally issued.

Special plates issued under this section are not subject to
section 168.1293, subdivision 2.

(a) The application for a special plate under this section must
indicate that the contribution specified under subdivision 1, clause (5), is a minimum annual
contribution to receive the plates, and that the applicant may make additional contributions.

(b) Funds from the contribution under subdivision 1, clause (5), must be deposited in
the bicycle safety and information account established in section 174.38, subdivision 1.

This section is effective January 1, 2014, for special Pedal
Minnesota plates issued on or after that date.

new text begin Bicycle safety and information account. new text end
new text begin
(a) A bicycle safety and
information account is established in the special revenue fund. The account consists of
funds contributed under sections 168.013, subdivision 22, and 168.1299, and any other
money donated, allotted, transferred, or otherwise provided to the account.

(b) Money in the account is annually appropriated to the commissioner of
transportation for the purposes specified in subdivision 2, except that an amount equal to
the total cost associated with the development and issuance of the special plates under
section 168.1299 and with optional donations under section 168.013, subdivision 22, is
first appropriated to the commissioner of public safety.

new text begin Bicycle safety and education; grants. new text end

(a) The commissioner shall,
in consultation with the advisory committee on nonmotorized transportation, develop
and implement a grantmaking process to annually allocate funds in the bicycle safety
and information account. The grantmaking process shall specify, but is not limited to,
eligibility criteria, application and grant decision-making procedures, and allowable usage
of grant funds.

(b) The commissioner shall annually provide at least 50 percent of available funds as
grants to eligible recipients, and may use the remaining funds for:

(1) program administration; and
new text end
new text begin
(2) bicycle safety, awareness, information, or education.

(c) The commissioner shall provide grants to an organization that:

new text begin
(1) is a charitable entity under section 501(c)(3) of the Internal Revenue Code, as
defined in section 289A.02, subdivision 7; and

new text begin
(2) has a mission or primary goal that includes bicycle safety, awareness,
information, or education.

(d) From a grant under this section, a recipient shall provide resources and
implement programs designed to improve bicycle safety and awareness.
