  1.1                          A bill for an act 
  1.2             relating to human services; providing supplementary 
  1.3             rates for certain group residential housing; amending 
  1.4             Minnesota Statutes 1994, section 256I.05, by adding a 
  1.5             subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 256I.05, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 1d.  [SUPPLEMENTARY RATES FOR CERTAIN SETTINGS 
  1.10  SERVING PERSONS WITH MENTAL ILLNESS OR CHEMICAL DEPENDENCY.] 
  1.11  Notwithstanding the provisions of subdivisions 1a and 1c, a 
  1.12  county agency may, at its option, negotiate a supplementary rate 
  1.13  for settings of five or more persons according to clauses (1) to 
  1.14  (4): 
  1.15     (1) the setting provides 24-hour support services to 
  1.16  persons with special needs for support; 
  1.17     (2) the residents have been offered an opportunity to apply 
  1.18  for admission to a licensed residential treatment program for 
  1.19  mental illness or chemical dependency and have refused that 
  1.20  offer and their refusal has been documented in writing; 
  1.21     (3) the residents are not eligible for home and 
  1.22  community-based service waivers because of their special need 
  1.23  for support; and 
  1.24     (4) the supplementary service rate does not exceed the 
  1.25  limits for residential care services described in section 
  2.1   256B.0913, subdivision 5, for an individual with a case mix "A" 
  2.2   classification.
