  1.1                          A bill for an act 
  1.2             relating to education; modifying school lunch aid and 
  1.3             targeted breakfast grants; appropriating money for 
  1.4             school lunch and food storage aid, school breakfast, 
  1.5             and targeted breakfast grants; amending Minnesota 
  1.6             Statutes 1998, section 124D.111, subdivision 1; Laws 
  1.7             1997, First Special Session chapter 4, article 6, 
  1.8             section 19. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1998, section 124D.111, 
  1.11  subdivision 1, is amended to read: 
  1.12     Subdivision 1.  [SCHOOL LUNCH AID COMPUTATION.] Each school 
  1.13  year, the state must pay districts participating in the national 
  1.14  school lunch program the amount of 6.5 ten cents for each full 
  1.15  paid, reduced, and free student lunch served to students in the 
  1.16  district. 
  1.17     Sec. 2.  Laws 1997, First Special Session chapter 4, 
  1.18  article 6, section 19, is amended to read: 
  1.19     Sec. 19.  [TARGETED BREAKFAST GRANTS.] 
  1.20     Subdivision 1.  [ESTABLISHMENT.] A grant program is 
  1.21  established to further explore the policy of providing provide 
  1.22  nutritious breakfasts to public elementary school children, 
  1.23  without regard to whether the children are eligible to receive 
  1.24  free or reduced price meals, so that they can learn effectively. 
  1.25     Subd. 2.  [ELIGIBILITY.] An applicant for a grant must be 
  1.26  an elementary school that participates in the federal school 
  1.27  breakfast and lunch programs.  For a school to receive a grant, 
  2.1   at least 33 percent of the lunches the school served to children 
  2.2   during the preceding school year must have been provided free or 
  2.3   at a reduced price. 
  2.4      Subd. 3.  [APPLICATION PROCESS.] To obtain a grant to 
  2.5   receive reimbursement for providing breakfasts to all children, 
  2.6   whether or not the children are from low-income families and 
  2.7   eligible to receive free or reduced price meals, a public 
  2.8   elementary school must submit an application to the commissioner 
  2.9   of children, families, and learning in the form and manner the 
  2.10  commissioner prescribes.  The application must describe how the 
  2.11  applicant will encourage all children in the school to 
  2.12  participate in the breakfast program.  The applicant also must 
  2.13  demonstrate to the commissioner that the applicant will receive 
  2.14  a $1 local match of funding or in-kind contributions for every 
  2.15  $3 of state funding the applicant receives.  The commissioner 
  2.16  may require additional information from the applicant. 
  2.17     Subd. 4.  [GRANT AWARDS.] The commissioner shall award 
  2.18  grants to the four grant recipients under Laws 1994, chapter 
  2.19  647, article 8, section 35 schools that received grants in the 
  2.20  preceding fiscal year, and then on a first-come, first-served 
  2.21  basis to all other schools that meet the requirements of 
  2.22  subdivisions 2 and 3 until funding under this section is 
  2.23  expended.  The commissioner shall determine the amount of the 
  2.24  grant using average statewide statistics and individual school 
  2.25  statistics adjusted for other state and federal reimbursements.  
  2.26  Grant recipients must use the proceeds to provide breakfasts to 
  2.27  school children every day school is in session. 
  2.28     Sec. 3.  [REVISOR INSTRUCTION.] 
  2.29     In the next and subsequent editions of Minnesota Statutes, 
  2.30  the revisor shall codify section 2 as 124D.1171. 
  2.31     Sec. 4.  [APPROPRIATIONS.] 
  2.32     Subdivision 1.  [DEPARTMENT OF CHILDREN, FAMILIES, AND 
  2.33  LEARNING.] The sums indicated in this section are appropriated 
  2.34  from the general fund to the department of children, families, 
  2.35  and learning for the fiscal years designated. 
  2.36     Subd. 2.  [SCHOOL LUNCH AND FOOD STORAGE AID.] For school 
  3.1   lunch aid according to Minnesota Statutes, section 124D.111, and 
  3.2   Code of Federal Regulations, title 7, section 210.17, and for 
  3.3   food storage and transportation costs for United States 
  3.4   Department of Agriculture donated commodities; and for a 
  3.5   temporary transfer to the commodity processing revolving fund to 
  3.6   provide cash flow to permit schools and other recipients of 
  3.7   donated commodities to take advantage of volume processing rates 
  3.8   and for school milk aid according to Minnesota Statutes, section 
  3.9   124D.118: 
  3.10       $11,600,000     .....     2000

  3.12     If this appropriation is insufficient, school lunch and 
  3.13  food storage aid may receive transfer funding under Minnesota 
  3.14  Statutes, section 127A.41, subdivision 8. 
  3.15     Subd. 3.  [SCHOOL BREAKFAST.] To operate the school 
  3.16  breakfast program: 
  3.17       $   456,000     .....     2000

  3.19     If this appropriation is insufficient, the school breakfast 
  3.20  program may receive transfer funding under Minnesota Statutes, 
  3.21  section 127A.41, subdivision 8. 
  3.22     Subd. 4.  [TARGETED BREAKFAST GRANTS.] For targeted 
  3.23  breakfast grants: 
  3.24       $ 3,700,000     .....     2000 
  3.25       $ 3,700,000     .....     2001 
  3.26     A school that receives a targeted breakfast grant may not 
  3.27  be reimbursed for its school breakfast program under Minnesota 
  3.28  Statutes, section 124D.115.
