  1.1                          A bill for an act 
  1.2             relating to alcoholic beverages; eliminating the 
  1.3             requirement that retail licensees furnish proof of 
  1.4             financial responsibility; amending Minnesota Statutes 
  1.5             1994, sections 62I.02, subdivision 4; 340A.404, 
  1.6             subdivision 10; and 340A.405, subdivision 4; repealing 
  1.7             Minnesota Statutes 1994, sections 340A.409; and 
  1.8             340A.603. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1994, section 62I.02, 
  1.11  subdivision 4, is amended to read: 
  1.12     Subd. 4.  [LIQUOR LIABILITY.] Policies and contracts of 
  1.13  coverage issued under this section for the purposes of providing 
  1.14  liquor liability insurance must contain the usual and customary 
  1.15  provisions of liability insurance policies, and must contain at 
  1.16  least the minimum coverage required by section 340A.409, 
  1.17  subdivision 1, or the local governing unit. 
  1.18     Sec. 2.  Minnesota Statutes 1994, section 340A.404, 
  1.19  subdivision 10, is amended to read: 
  1.20     Subd. 10.  [TEMPORARY ON-SALE LICENSES.] The governing body 
  1.21  of a municipality may issue to a club or charitable, religious, 
  1.22  or other nonprofit organization in existence for at least three 
  1.23  years, or to a political committee registered under section 
  1.24  10A.14, a temporary license for the on-sale of intoxicating 
  1.25  liquor in connection with a social event within the municipality 
  1.26  sponsored by the licensee.  The license may authorize the 
  1.27  on-sale of intoxicating liquor for not more than three 
  2.1   consecutive days, and may authorize on-sales on premises other 
  2.2   than premises the licensee owns or permanently occupies.  The 
  2.3   license may provide that the licensee may contract for 
  2.4   intoxicating liquor catering services with the holder of a 
  2.5   full-year on-sale intoxicating liquor license issued by any 
  2.6   municipality.  The licenses are subject to the terms, including 
  2.7   a license fee, imposed by the issuing municipality.  Licenses 
  2.8   issued under this subdivision are subject to all laws and 
  2.9   ordinances governing the sale of intoxicating liquor except 
  2.10  section 340A.409 and those laws and ordinances which by their 
  2.11  nature are not applicable.  Licenses under this subdivision are 
  2.12  not valid unless first approved by the commissioner of public 
  2.13  safety. 
  2.14     A county under this section may issue a temporary license 
  2.15  only to a premises located in the unincorporated or unorganized 
  2.16  territory of the county. 
  2.17     Sec. 3.  Minnesota Statutes 1994, section 340A.405, 
  2.18  subdivision 4, is amended to read: 
  2.19     Subd. 4.  [TEMPORARY OFF-SALE LICENSES; WINE AUCTIONS.] (a) 
  2.20  The governing body of a city or county may issue a temporary 
  2.21  license for the off-sale of wine at an auction with the approval 
  2.22  of the commissioner.  A license issued under this subdivision 
  2.23  authorizes the sale of only vintage wine of a brand and vintage 
  2.24  that is not commonly being offered for sale by any wholesaler in 
  2.25  Minnesota.  The license may authorize the off-sale of wine for 
  2.26  not more than three consecutive days provided not more than 600 
  2.27  cases of wine are sold at any auction.  The licenses are subject 
  2.28  to the terms, including license fee, imposed by the issuing city 
  2.29  or county.  Licenses issued under this subdivision are subject 
  2.30  to all laws and ordinances governing the sale of intoxicating 
  2.31  liquor except section 340A.409 and those laws and ordinances 
  2.32  which by their nature are not applicable.  
  2.33     (b) As used in the subdivision, "vintage wine" means 
  2.34  bottled wine which is at least five years old.  
  2.35     Sec. 4.  [REPEALER.] 
  2.36     Minnesota Statutes 1994, sections 340A.409; and 340A.603, 
  3.1   are repealed. 
  3.2      Sec. 5.  [EFFECTIVE DATE.] 
  3.3      Sections 1 to 4 are effective July 1, 1995.
