  1.1                          A bill for an act 
  1.2             relating to commerce; requiring certain fire 
  1.3             protection notifications in contracts for the sale of 
  1.4             certain newly constructed residential dwellings; 
  1.5             proposing coding for new law in Minnesota Statutes, 
  1.6             chapter 325F. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [325F.243] [CONSTRUCTION OF RESIDENTIAL 
  1.9   DWELLINGS; FIRE PROTECTION NOTIFICATION.] 
  1.10     Subdivision 1.  [DEFINITIONS.] For purposes of this section 
  1.11  the following terms have the meanings given them: 
  1.12     (1) "dwelling" means a new building to be constructed for 
  1.13  one family; 
  1.14     (2) "vendee" means a purchaser of a dwelling; 
  1.15     (3) "vendor" means a person, partnership, corporation, or 
  1.16  other legal entity that constructs dwellings for the purpose of 
  1.17  sale, including the construction of dwellings on land owned by 
  1.18  vendees. 
  1.19     Subd. 2.  [FIRE PROTECTION SYSTEM NOTIFICATION.] If a 
  1.20  purchase agreement, earnest money agreement, construction 
  1.21  contract, or similar contract for the construction or sale of a 
  1.22  dwelling is executed before construction of the dwelling begins, 
  1.23  then before the agreement or contract is executed, the vendor 
  1.24  shall either (1) give the vendee an informational fire 
  1.25  protection system brochure provided by the Minnesota state fire 
  1.26  chiefs association; or (2) inform the vendee that automatic fire 
  2.1   protection sprinklers may be installed in the dwelling.  Failure 
  2.2   to provide the notification required by this section shall not 
  2.3   give rise to liability on the part of the vendor. 
  2.4      Subd. 3.  [ACKNOWLEDGMENT OF NOTIFICATION.] The vendee 
  2.5   shall acknowledge in the contract or on a separate form provided 
  2.6   by the vendor that the vendee has received the notification 
  2.7   required by subdivision 2. 
  2.8      Subd. 4.  [EXPIRATION.] This section expires on December 
  2.9   31, 2003.
