  1.1                          A bill for an act 
  1.2             relating to corrections; modifying the law prohibiting 
  1.3             inmates from bringing actions to challenge the level 
  1.4             of expenditures for rehabilitation programs; amending 
  1.5             Minnesota Statutes 1998, section 244.03. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 244.03, is 
  1.8   amended to read: 
  1.9      244.03 [REHABILITATIVE PROGRAMS.] 
  1.10     The commissioner shall provide appropriate mental health 
  1.11  programs and vocational and educational programs with 
  1.12  employment-related goals for inmates who desire to voluntarily 
  1.13  participate in such programs and for inmates who are required to 
  1.14  participate in the programs under the disciplinary offense rules 
  1.15  adopted by the commissioner under section 244.05, subdivision 
  1.16  1b.  The selection, design and implementation of programs under 
  1.17  this section shall be the sole responsibility of the 
  1.18  commissioner, acting within the limitations imposed by the funds 
  1.19  appropriated for such programs. 
  1.20     No action challenging the level of expenditures for 
  1.21  programs authorized under this section, nor any action 
  1.22  challenging the selection, design or implementation of these 
  1.23  programs, to include employee assignments, may be maintained by 
  1.24  an inmate in any court or in any licensing or certification 
  1.25  board in this state.
