  1.1                          A bill for an act
  1.2             relating to drivers' licenses; requiring applicants 
  1.3             under age 18 to be certified by a parent or guardian 
  1.4             as having had at least 50 hours of driving before 
  1.5             being eligible for a license; amending Minnesota 
  1.6             Statutes 1996, section 171.04, subdivision 1. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1996, section 171.04, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [PERSONS NOT ELIGIBLE.] The department 
  1.11  shall not issue a driver's license hereunder: 
  1.12     (1) To any person who is under the age of 16 years; to any 
  1.13  person under 18 years unless such person shall have successfully 
  1.14  completed a course in driver education, including both classroom 
  1.15  and behind-the-wheel instruction, approved by the state board of 
  1.16  education for courses offered through the public schools, or, in 
  1.17  the case of a course offered by a private, commercial driver 
  1.18  education school or institute, by the department of public 
  1.19  safety; except when such person has completed a course of driver 
  1.20  education in another state or has a previously issued valid 
  1.21  license from another state or country; nor to any person under 
  1.22  18 years unless the application of license is approved by either 
  1.23  parent when both reside in the same household as the minor 
  1.24  applicant, otherwise the parent or spouse of the parent having 
  1.25  custody or with whom the minor is living in the event there is 
  1.26  no court order for custody, or guardian having the custody of 
  2.1   such minor, or in the event a person under the age of 18 has no 
  2.2   living father, mother or guardian, the license shall not be 
  2.3   issued to such person unless the application therefor is 
  2.4   approved by the person's employer.  Driver education courses 
  2.5   offered in any public school shall be open for enrollment to 
  2.6   persons between the ages of 15 and 18 years residing in the 
  2.7   school district or attending school therein.  Any public school 
  2.8   offering driver education courses may charge an enrollment fee 
  2.9   for the driver education course which shall not exceed the 
  2.10  actual cost thereof to the public school and the school 
  2.11  district.  The approval required herein shall contain a 
  2.12  verification of the age of the applicant; 
  2.13     (2) To any person who is under the age of 18 years unless 
  2.14  the person has applied for, been issued, and possessed the 
  2.15  appropriate instruction permit for a minimum of six months and 
  2.16  presents with the driver's license application a certification 
  2.17  signed by a parent or guardian of the applicant that states that 
  2.18  the applicant has driven a motor vehicle at least 50 hours, 
  2.19  including at least ten hours at night, while accompanied by a 
  2.20  parent or guardian or, with a parent's or guardian's permission, 
  2.21  accompanied by another licensed driver at least 21 years of age; 
  2.22     (3) To any person whose license has been suspended during 
  2.23  the period of suspension except that a suspended license may be 
  2.24  reinstated during the period of suspension upon the licensee 
  2.25  furnishing proof of financial responsibility in the same manner 
  2.26  as provided in the Minnesota no-fault automobile insurance act; 
  2.27     (4) To any person whose license has been revoked except 
  2.28  upon furnishing proof of financial responsibility in the same 
  2.29  manner as provided in the Minnesota no-fault automobile 
  2.30  insurance act and if otherwise qualified; 
  2.31     (5) To any person who is a drug dependent person as defined 
  2.32  in section 254A.02, subdivision 5; 
  2.33     (6) To any person who has been adjudged legally incompetent 
  2.34  by reason of mental illness, mental deficiency, or inebriation, 
  2.35  and has not been restored to capacity, unless the department is 
  2.36  satisfied that such person is competent to operate a motor 
  3.1   vehicle with safety to persons or property; 
  3.2      (7) To any person who is required by this chapter to take 
  3.3   an examination, unless such person shall have successfully 
  3.4   passed such examination; 
  3.5      (8) To any person who is required under the provisions of 
  3.6   the Minnesota no-fault automobile insurance act of this state to 
  3.7   deposit proof of financial responsibility and who has not 
  3.8   deposited such proof; 
  3.9      (9) To any person when the commissioner has good cause to 
  3.10  believe that the operation of a motor vehicle on the highways by 
  3.11  such person would be inimical to public safety or welfare; 
  3.12     (10) To any person when, in the opinion of the 
  3.13  commissioner, such person is afflicted with or suffering from 
  3.14  such physical or mental disability or disease as will affect 
  3.15  such person in a manner to prevent the person from exercising 
  3.16  reasonable and ordinary control over a motor vehicle while 
  3.17  operating the same upon the highways; nor to a person who is 
  3.18  unable to read and understand official signs regulating, 
  3.19  warning, and directing traffic; 
  3.20     (11) To a child for whom a court has ordered denial of 
  3.21  driving privileges under section 260.191, subdivision 1, or 
  3.22  260.195, subdivision 3a, until the period of denial is 
  3.23  completed; or 
  3.24     (12) To any person whose license has been canceled, during 
  3.25  the period of cancellation.
