A bill for an act
relating to public safety; school buses; providing for postcrash procedures for
school bus in an accident; amending Minnesota Statutes 2008, section 169.4511,
subdivision 1.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 169.4511, subdivision 1, is amended to
read:


Subdivision 1.

Postcrash inspection.

(a) A peace officer responding to an accident
involving a school bus or Head Start bus must immediately notify the State Patrol if the
accident results in deleted text begin death or serious personal injury on the school bus, or property damage
to the school bus of an apparent extent of more than $4,400

new text begin (1) a fatality;

new text begin (2) bodily injury to a person who, as a result of the injury, immediately receives
medical treatment away from the scene of the accident; or

new text begin (3) one or more motor vehicles incurring disabling damage as a result of the
accident, requiring a motor vehicle to be transported away from the scene by tow truck or
other motor vehicle

new text begin (b) new text end No person shall drive or knowingly permit or cause to be driven, for the purpose
of transporting students, any school bus or Head Start bus after such an accident unless:

(1) the vehicle has been inspected by the Minnesota State Patrol and the State Patrol
has determined that the vehicle may safely be operated; or

(2) a waiver has been granted under subdivision 2.
