  1.1                          A bill for an act 
  1.2             relating to state government; increasing the 
  1.3             membership of the designer selection board; requiring 
  1.4             representation on the board from each congressional 
  1.5             district; amending Minnesota Statutes 1994, section 
  1.6             16B.33, subdivision 2. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 16B.33, 
  1.9   subdivision 2, is amended to read: 
  1.10     Subd. 2.  [ORGANIZATION OF BOARD.] (a) [MEMBERSHIP.] The 
  1.11  state designer selection board consists of five eight 
  1.12  individuals, the majority of whom must be Minnesota residents 
  1.13  one from each congressional district in the state.  Each of the 
  1.14  following three organizations shall nominate one individual two 
  1.15  individuals, whose name names and qualifications shall must be 
  1.16  submitted to the commissioner of administration for 
  1.17  consideration:  the consulting engineers council of Minnesota 
  1.18  after consultation with other professional engineering societies 
  1.19  in the state; the Minnesota society of architects; and the 
  1.20  Minnesota board of the arts.  The commissioner may appoint 
  1.21  the three six named individuals to the board but may reject a 
  1.22  nominated individual and request another nomination.  The 
  1.23  remaining two members shall must also be appointed by the 
  1.24  commissioner.  
  1.25     (b) [NONVOTING MEMBERS.] In addition to the five eight 
  1.26  members of the board, two nonvoting members shall participate in 
  2.1   the interviewing and selection of designers pursuant to under 
  2.2   this section.  One shall must be a representative of the 
  2.3   commissioner and shall participate in the interviewing and 
  2.4   selection of designers for all projects.  The other shall must 
  2.5   be a representative of the user agency, who shall participate in 
  2.6   the interviewing and selection of the designers for the project 
  2.7   being undertaken by the user agency.  The commissioner shall 
  2.8   appoint the representative of the user agency in consultation 
  2.9   with the user agency.  
  2.10     (c) [TERMS; COMPENSATION; REMOVAL; VACANCIES.] The 
  2.11  membership terms, compensation, removal of members, and filling 
  2.12  of vacancies on the board are as provided in section 15.0575.  
  2.13  No individual may serve for more than two consecutive terms.  
  2.14     (d) [OFFICERS, RULES.] At its first meeting, the board 
  2.15  shall elect a voting member of the board as chair.  The board 
  2.16  shall also elect other officers necessary for the conduct of its 
  2.17  affairs.  The board shall adopt rules governing its operations 
  2.18  and the conduct of its meetings.  The rules shall must provide 
  2.19  for the terms of the chair and other officers.  
  2.20     (e) [MEETINGS.] The board shall meet as often as is 
  2.21  necessary, not less than twice annually, in order to act 
  2.22  expeditiously on requests submitted to it for selection of 
  2.23  primary designers.  
  2.24     (f) [OFFICE, STAFF, RECORDS.] The department of 
  2.25  administration shall provide the board with suitable quarters to 
  2.26  maintain an office, hold meetings, and keep records.  The 
  2.27  commissioner shall designate an employee of the department of 
  2.28  administration to serve as executive secretary to the board and 
  2.29  shall furnish a secretarial staff to the board as necessary for 
  2.30  the expeditious conduct of the board's duties and 
  2.31  responsibilities.
