  1.1                          A bill for an act 
  1.2             relating to health; exempting certain advisory 
  1.3             councils and committees from expiration; amending 
  1.4             Minnesota Statutes 1996, sections 145.881, subdivision 
  1.5             1; and 145A.10, subdivision 10. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 145.881, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [COMPOSITION OF TASK FORCE.] The 
  1.10  commissioner shall establish and appoint a maternal and child 
  1.11  health advisory task force consisting of 15 members who will 
  1.12  provide equal representation from:  
  1.13     (1) professionals with expertise in maternal and child 
  1.14  health services; 
  1.15     (2) representatives of community health boards as defined 
  1.16  in section 145A.02, subdivision 5; and 
  1.17     (3) consumer representatives interested in the health of 
  1.18  mothers and children.  
  1.19     No members shall be employees of the state department of 
  1.20  health.  Task force members shall be appointed and removed as 
  1.21  provided in section 15.059, subdivisions 2 and 4.  The maternal 
  1.22  and child health advisory task force shall terminate on the date 
  1.23  provided by section 15.059, subdivision 5, and members shall 
  1.24  receive compensation as provided in Section 15.059, subdivision 
  1.25  6 governs the maternal and child health advisory task force, 
  2.1   except section 15.059, subdivision 5, does not apply. 
  2.2      Sec. 2.  Minnesota Statutes 1996, section 145A.10, 
  2.3   subdivision 10, is amended to read: 
  2.4      Subd. 10.  [STATE AND LOCAL ADVISORY COMMITTEES.] (a) A 
  2.5   state community health advisory committee is established to 
  2.6   advise, consult with, and make recommendations to the 
  2.7   commissioner on the development, maintenance, funding, and 
  2.8   evaluation of community health services.  Section 15.059, 
  2.9   subdivision 5, applies does not apply to this committee.  Each 
  2.10  community health board may appoint a member to serve on the 
  2.11  committee.  The committee must meet at least quarterly, and 
  2.12  special meetings may be called by the committee chair or a 
  2.13  majority of the members.  Members or their alternates may 
  2.14  receive a per diem and must be reimbursed for travel and other 
  2.15  necessary expenses while engaged in their official duties. 
  2.16     (b) The city councils or county boards that have 
  2.17  established or are members of a community health board must 
  2.18  appoint a community health advisory committee to advise, consult 
  2.19  with, and make recommendations to the community health board on 
  2.20  matters relating to the development, maintenance, funding, and 
  2.21  evaluation of community health services.  The committee must 
  2.22  consist of at least five members and must be generally 
  2.23  representative of the population and health care providers of 
  2.24  the community health service area.  The committee must meet at 
  2.25  least three times a year and at the call of the chair or a 
  2.26  majority of the members.  Members may receive a per diem and 
  2.27  reimbursement for travel and other necessary expenses while 
  2.28  engaged in their official duties. 
  2.29     (c) State and local advisory committees must adopt bylaws 
  2.30  or operating procedures that specify the length of terms of 
  2.31  membership, procedures for assuring that no more than half of 
  2.32  these terms expire during the same year, and other matters 
  2.33  relating to the conduct of committee business.  Bylaws or 
  2.34  operating procedures may allow one alternate to be appointed for 
  2.35  each member of a state or local advisory committee.  Alternates 
  2.36  may be given full or partial powers and duties of members.
