  1.1                          A bill for an act 
  1.2             relating to education; allowing tenth grade students 
  1.3             to participate in the post-secondary enrollment 
  1.4             options program; amending Minnesota Statutes 2002, 
  1.5             section 124D.09, subdivisions 4, 5, 7, 8, 9. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 124D.09, 
  1.8   subdivision 4, is amended to read: 
  1.9      Subd. 4.  [ALTERNATIVE PUPIL.] "Alternative pupil" means an 
  1.10  a 10th, 11th, or 12th grade student not enrolled in a public 
  1.11  school district, and includes students attending nonpublic 
  1.12  schools and students who are home schooled.  An alternative 
  1.13  pupil is considered a pupil for purposes of this section only.  
  1.14  An alternative pupil must register with the commissioner of 
  1.15  children, families, and learning before participating in the 
  1.16  post-secondary enrollment options program.  The commissioner 
  1.17  shall prescribe the form and manner of the registration, in 
  1.18  consultation with the nonpublic education council under section 
  1.19  123B.445, and may request any necessary information from the 
  1.20  alternative pupil. 
  1.21     [EFFECTIVE DATE.] This section is effective for the 
  1.22  2003-2004 school year and later. 
  1.23     Sec. 2.  Minnesota Statutes 2002, section 124D.09, 
  1.24  subdivision 5, is amended to read: 
  1.25     Subd. 5.  [AUTHORIZATION; NOTIFICATION.] Notwithstanding 
  2.1   any other law to the contrary, an a 10th, 11th, or 12th grade 
  2.2   pupil enrolled in a school or an American Indian-controlled 
  2.3   tribal contract or grant school eligible for aid under section 
  2.4   124D.83, except a foreign exchange pupil enrolled in a district 
  2.5   under a cultural exchange program, may apply to an eligible 
  2.6   institution, as defined in subdivision 3, to enroll in 
  2.7   nonsectarian courses offered by that post-secondary 
  2.8   institution.  If an institution accepts a secondary pupil for 
  2.9   enrollment under this section, the institution shall send 
  2.10  written notice to the pupil, the pupil's school or school 
  2.11  district, and the commissioner within ten days of acceptance.  
  2.12  The notice must indicate the course and hours of enrollment of 
  2.13  that pupil.  If the pupil enrolls in a course for post-secondary 
  2.14  credit, the institution must notify the pupil about payment in 
  2.15  the customary manner used by the institution.  
  2.16     [EFFECTIVE DATE.] This section is effective for the 
  2.17  2003-2004 school year and later. 
  2.18     Sec. 3.  Minnesota Statutes 2002, section 124D.09, 
  2.19  subdivision 7, is amended to read: 
  2.20     Subd. 7.  [DISSEMINATION OF INFORMATION; NOTIFICATION OF 
  2.21  INTENT TO ENROLL.] By March 1 of each year, a district must 
  2.22  provide general information about the program to all pupils in 
  2.23  grades 9, 10, and 11.  To assist the district in planning, a 
  2.24  pupil shall inform the district by March 30 of each year of the 
  2.25  pupil's intent to enroll in post-secondary courses during the 
  2.26  following school year.  A pupil is not bound by notifying or not 
  2.27  notifying the district by March 30.  
  2.28     [EFFECTIVE DATE.] This section is effective for the 
  2.29  2003-2004 school year and later. 
  2.30     Sec. 4.  Minnesota Statutes 2002, section 124D.09, 
  2.31  subdivision 8, is amended to read: 
  2.32     Subd. 8.  [LIMIT ON PARTICIPATION.] A pupil who first 
  2.33  enrolls in grade 10 may not enroll in post-secondary courses 
  2.34  under this section for secondary credit for more than the 
  2.35  equivalent of three academic years.  A pupil who first enrolls 
  2.36  in grade 11 may not enroll in post-secondary courses under this 
  3.1   section for secondary credit for more than the equivalent of two 
  3.2   academic years.  A pupil who first enrolls in grade 12 may not 
  3.3   enroll in post-secondary courses under this section for 
  3.4   secondary credit for more than the equivalent of one academic 
  3.5   year.  If a pupil in grade 10, 11, or 12 first enrolls in a 
  3.6   post-secondary course for secondary credit during the school 
  3.7   year, the time of participation shall be reduced 
  3.8   proportionately.  If a pupil is in a learning year or other 
  3.9   year-round program and begins each grade in the summer session, 
  3.10  summer sessions shall not be counted against the time of 
  3.11  participation.  A pupil who has graduated from high school 
  3.12  cannot participate in a program under this section.  A pupil who 
  3.13  has completed course requirements for graduation but who has not 
  3.14  received a diploma may participate in the program under this 
  3.15  section.  
  3.16     [EFFECTIVE DATE.] This section is effective for the 
  3.17  2003-2004 school year and later. 
  3.18     Sec. 5.  Minnesota Statutes 2002, section 124D.09, 
  3.19  subdivision 9, is amended to read: 
  3.20     Subd. 9.  [ENROLLMENT PRIORITY.] A post-secondary 
  3.21  institution shall give priority to its post-secondary students 
  3.22  when enrolling 10th, 11th, and 12th grade pupils in its courses.
  3.23  A post-secondary institution may provide information about its 
  3.24  programs to a secondary school or to a pupil or parent, but it 
  3.25  may not advertise or otherwise recruit or solicit the 
  3.26  participation on financial grounds, secondary pupils to enroll 
  3.27  in its programs.  An institution must not enroll secondary 
  3.28  pupils, for post-secondary enrollment options purposes, in 
  3.29  remedial, developmental, or other courses that are not college 
  3.30  level.  Once a pupil has been enrolled in a post-secondary 
  3.31  course under this section, the pupil shall not be displaced by 
  3.32  another student.  
  3.33     [EFFECTIVE DATE.] This section is effective for the 
  3.34  2003-2004 school year and later.
