  1.1                          A bill for an act
  1.2             relating to education; creating a minimum aid 
  1.3             guarantee for school districts; amending Minnesota 
  1.4             Statutes 1994, sections 124A.23, by adding 
  1.5             subdivisions; and 124A.24. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 124A.23, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 3a.  [GENERAL EDUCATION LEVY; DISTRICTS RECEIVING 
  1.10  MINIMUM GUARANTEED AID.] If a school district qualifies for 
  1.11  minimum guaranteed aid according to subdivision 4a, the 
  1.12  district's general education levy computed according to 
  1.13  subdivision 3 shall be reduced by the amount of minimum 
  1.14  guaranteed aid received. 
  1.15     Sec. 2.  Minnesota Statutes 1994, section 124A.23, is 
  1.16  amended by adding a subdivision to read: 
  1.17     Subd. 4a.  [MINIMUM GUARANTEED AID.] If the amount of a 
  1.18  school district's general education aid computed according to 
  1.19  subdivision 4 is less than $1,000 per pupil unit, and the 
  1.20  district's total operating expenditures per pupil unit are in 
  1.21  the lowest 20th percentile of all school districts, the district 
  1.22  is eligible for minimum guaranteed aid.  Minimum guaranteed aid 
  1.23  is equal to $1,000 per pupil unit less the district's general 
  1.24  education aid per pupil unit.  Minimum guaranteed aid shall not 
  1.25  exceed $1,000,000 for any school district. 
  2.1      Sec. 3.  Minnesota Statutes 1994, section 124A.24, is 
  2.2   amended to read: 
  2.3      124A.24 [GENERAL EDUCATION LEVY EQUITY.] 
  2.4      If a district's general education levy is determined 
  2.5   according to section 124A.23, subdivision 3, and if the district 
  2.6   is not eligible for guaranteed minimum aid according to section 
  2.7   124A.23, subdivision 4a, an amount must be deducted from state 
  2.8   aid authorized in this chapter and chapters 124 and 124B, 
  2.9   receivable for the same school year, and from other state 
  2.10  payments receivable for the same school year authorized in 
  2.11  chapter 273.  The aid in section 124.646 must not be reduced. 
  2.12     The amount of the deduction equals the difference between: 
  2.13     (1) the general education tax rate, according to section 
  2.14  124A.23, times the district's adjusted net tax capacity used to 
  2.15  determine the general education aid for the same school year; 
  2.16  and 
  2.17     (2) the district's general education revenue, excluding 
  2.18  training and experience revenue and supplemental revenue, for 
  2.19  the same school year, according to section 124A.22. 
  2.20     Sec. 4.  [EFFECTIVE DATE.] 
  2.21     Sections 1 to 3 are effective July 1, 1995, for 1995-1996 
  2.22  and later school years.
