  1.1                          A bill for an act 
  1.2             relating to crime; making it a felony to flee a peace 
  1.3             officer by means of a motor vehicle; amending 
  1.4             Minnesota Statutes 1994, section 609.487, subdivision 
  1.5             3. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 609.487, 
  1.8   subdivision 3, is amended to read: 
  1.9      Subd. 3.  [FLEEING AN OFFICER.] Whoever by means of a motor 
  1.10  vehicle flees or attempts to flee a peace officer who is acting 
  1.11  in the lawful discharge of an official duty, and the perpetrator 
  1.12  knows or should reasonably know the same to be a peace officer, 
  1.13  is guilty of a felony and may be sentenced to imprisonment for 
  1.14  not more than one year and one day or to payment of a fine of 
  1.15  not more than $3,000 $4,000, or both.  Whoever violates this 
  1.16  subdivision a second or subsequent time is guilty of a felony 
  1.17  and may be sentenced to imprisonment for not more than one year 
  1.18  and one day two years or to payment of a fine of not more 
  1.19  than $3,000 $5,000, or both. 
  1.20     Sec. 2.  [EFFECTIVE DATE.] 
  1.21     Section 1 is effective August 1, 1995, and applies to 
  1.22  crimes committed on or after that date.
