  1.1                          A bill for an act 
  1.2             relating to game and fish; authorizing a hunting 
  1.3             season for mourning doves; requiring mourning dove 
  1.4             stamps; requiring a report on the impact of the 
  1.5             mourning dove season; amending Minnesota Statutes 
  1.6             2002, sections 97A.045, subdivision 7; 97A.055, 
  1.7             subdivision 2; 97A.075, by adding a subdivision; 
  1.8             97A.411, subdivision 2; 97A.475, subdivision 5; 
  1.9             proposing coding for new law in Minnesota Statutes, 
  1.10            chapter 97B; repealing Minnesota Statutes 2002, 
  1.11            section 97B.731, subdivision 2. 
  1.12  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.13     Section 1.  Minnesota Statutes 2002, section 97A.045, 
  1.14  subdivision 7, is amended to read: 
  1.15     Subd. 7.  [DUTY TO ENCOURAGE STAMP DESIGN AND PURCHASES.] 
  1.16  (a) The commissioner shall encourage the purchase of: 
  1.17     (1) Minnesota migratory waterfowl stamps by nonhunters 
  1.18  interested in migratory waterfowl preservation and habitat 
  1.19  development; 
  1.20     (2) pheasant stamps by persons interested in pheasant 
  1.21  habitat improvement; 
  1.22     (3) trout and salmon stamps by persons interested in trout 
  1.23  and salmon stream and lake improvement; and 
  1.24     (4) turkey stamps by persons interested in wild turkey 
  1.25  management and habitat improvement; and 
  1.26     (5) mourning dove stamps by persons interested in game and 
  1.27  nongame wildlife management.  
  1.28     (b) The commissioner shall make rules governing contests 
  2.1   for selecting a design for each stamp, including those stamps 
  2.2   not required to be in possession while taking game or fish. 
  2.3      Sec. 2.  Minnesota Statutes 2002, section 97A.055, 
  2.4   subdivision 2, is amended to read: 
  2.5      Subd. 2.  [RECEIPTS.] The state treasurer shall credit to 
  2.6   the game and fish fund all money received under the game and 
  2.7   fish laws including receipts from:  
  2.8      (1) licenses issued, except for mourning dove stamps; 
  2.9      (2) fines and forfeited bail; 
  2.10     (3) sales of contraband, wild animals, and other property 
  2.11  under the control of the division; 
  2.12     (4) fees from advanced education courses for hunters and 
  2.13  trappers; 
  2.14     (5) reimbursements of expenditures by the division; 
  2.15     (6) contributions to the division; and 
  2.16     (7) revenue credited to the game and fish fund under 
  2.17  section 297A.94, paragraph (e), clause (1). 
  2.18     Sec. 3.  Minnesota Statutes 2002, section 97A.075, is 
  2.19  amended by adding a subdivision to read: 
  2.20     Subd. 6.  [MOURNING DOVE STAMPS.] (a) 90 percent of $5 from 
  2.21  the sale of each mourning dove stamp must be credited to the 
  2.22  nongame wildlife management account. 
  2.23     (b) The 90 percent of remaining revenue from mourning dove 
  2.24  stamps must be credited to the mourning dove habitat improvement 
  2.25  account.  Money in the account may be used only for: 
  2.26     (1) the development, restoration, and maintenance of 
  2.27  suitable habitat for mourning doves on public and private land 
  2.28  including establishment of nesting cover and reliable food 
  2.29  sources; 
  2.30     (2) acquisitions of, or easements on, mourning dove 
  2.31  habitat; 
  2.32     (3) reimbursement of expenditures to provide mourning dove 
  2.33  habitat on public and private land; and 
  2.34     (4) the promotion of mourning dove habitat development and 
  2.35  maintenance, population surveys and monitoring, and research. 
  2.36     (c) Money in the account may not be used for: 
  3.1      (1) costs unless they are directly related to a specific 
  3.2   parcel of land under paragraph (b), clauses (1) to (3), or to 
  3.3   specific promotional or evaluative activities under paragraph 
  3.4   (b), clause (4); or 
  3.5      (2) any permanent personnel costs.  
  3.6      (d) Unsold mourning dove stamps in excess of 3,000 shall be 
  3.7   destroyed by the commissioner one year after the date of 
  3.8   issuance.  The commissioner shall offer for sale at public 
  3.9   auction any remaining stamps of 3,000 or less. 
  3.10     Sec. 4.  Minnesota Statutes 2002, section 97A.411, 
  3.11  subdivision 2, is amended to read: 
  3.12     Subd. 2.  [SIGNATURE ON STAMPS.] A migratory waterfowl, 
  3.13  mourning dove, or pheasant stamp issued under the game and fish 
  3.14  laws must be signed by the licensee across the front of the 
  3.15  stamp to be valid. 
  3.16     Sec. 5.  Minnesota Statutes 2002, section 97A.475, 
  3.17  subdivision 5, is amended to read: 
  3.18     Subd. 5.  [HUNTING STAMPS.] Fees for the following stamps 
  3.19  and stamp validations are: 
  3.20     (1) migratory waterfowl stamp, $5 $7.50; 
  3.21     (2) pheasant stamp, $5 $7.50; and 
  3.22     (3) turkey stamp validation, $5; and 
  3.23     (4) mourning dove stamp, $7.50.  
  3.24     Sec. 6.  [97B.717] [MOURNING DOVES.] 
  3.25     Subdivision 1.  [SEASON.] The commissioner shall prescribe 
  3.26  an open season for taking mourning doves. 
  3.27     Subd. 2.  [LICENSE AND STAMP REQUIRED.] A person may not 
  3.28  take mourning doves without a small game license and a mourning 
  3.29  dove stamp in possession.  
  3.30     Sec. 7.  [REPORT.] 
  3.31     The commissioner shall report to the legislature by March 
  3.32  1, 2004, on the results of the mourning dove season authorized 
  3.33  by Minnesota Statutes, section 97B.717.  The report must include 
  3.34  a description of the impact of the season on the mourning dove 
  3.35  population in the state. 
  3.36     Sec. 8.  [REPEALER.] 
  4.1      Minnesota Statutes 2002, section 97B.731, subdivision 2, is 
  4.2   repealed. 
  4.3      Sec. 9.  [EFFECTIVE DATE.] 
  4.4      Sections 1 to 8 are effective the day following final 
  4.5   enactment.
