  1.1                          A bill for an act 
  1.2             relating to elections; clarifying certain duties; 
  1.3             amending Minnesota Statutes 2002, section 204D.04, 
  1.4             subdivision 2. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2002, section 204D.04, 
  1.7   subdivision 2, is amended to read: 
  1.8      Subd. 2.  [INSTRUCTIONS TO PRINTER; PRINTER'S BOND.] (a) 
  1.9   The official charged with the preparation and distribution of 
  1.10  the ballots shall prepare instructions to the printer for 
  1.11  rotation of the names of candidates and for layout of the ballot.
  1.12     (b) Except as provided in paragraph (c), the instructions 
  1.13  shall be approved by the legal advisor of the official before 
  1.14  delivery to the printer. 
  1.15     (c) The legal advisor of a town official is only not 
  1.16  required to approve instructions regarding the rotation of the 
  1.17  names of candidates on the ballot or the layout of the ballot. 
  1.18     (d) Before a contract exceeding $1,000 is awarded for 
  1.19  printing ballots, the printer shall furnish a sufficient bond, 
  1.20  letter of credit, or certified check, acceptable to the official 
  1.21  responsible for printing the ballots, conditioned on printing 
  1.22  the ballots in conformity with the Minnesota Election Law and 
  1.23  the instructions delivered.  The official responsible for 
  1.24  printing the ballots shall set the amount of the bond, letter of 
  1.25  credit, or certified check in an amount equal to the value of 
  2.1   the purchase.
