  1.1                          A bill for an act 
  1.2             relating to retirement; authorizing participation in a 
  1.3             retirement incentive by a certain retired member of 
  1.4             the public employees retirement association. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [CERTAIN CITY ATTORNEY; ANNUITY COMPUTATION.] 
  1.7      A retired member of the public employees retirement 
  1.8   association who retired from employment as city attorney for the 
  1.9   city of West St. Paul on January 30, 1994, but who continued to 
  1.10  perform legal services for the city as an independent contractor 
  1.11  until the city retained a successor legal counsel on May 9, 
  1.12  1994, shall be deemed to have terminated public service on 
  1.13  January 30, 1994, and shall be eligible for the retirement 
  1.14  incentive provided by Laws 1993, chapter 192, section 108, 
  1.15  subdivision 3, notwithstanding the fact that there was no 
  1.16  interruption of legal service for 30 days after January 30, 1994.
  1.17     Sec. 2.  [EFFECTIVE DATE.] 
  1.18     Section 1 is effective the day following final enactment.  
  1.19  The annuity payable under section 1 shall be recalculated and 
  1.20  paid retroactively to the date the annuity was first paid to the 
  1.21  retiree.
