  1.1                          A bill for an act 
  1.2             relating to transportation; clarifying that specific 
  1.3             service signs may be placed at certain intersections 
  1.4             of trunk highways; defining residential roadway; 
  1.5             defining daytime and nighttime; correcting obsolete 
  1.6             reference; abolishing rules governing individual 
  1.7             eligibility for special transportation services; 
  1.8             amending Minnesota Statutes 1996, sections 160.292, 
  1.9             subdivision 5; 169.01, subdivision 81, and by adding 
  1.10            subdivisions; and 169.14, subdivision 5d; repealing 
  1.11            Minnesota Rules, parts 8840.0100; 8840.0200; 
  1.12            8840.0300; 8840.0400; 8840.0500; 8840.0600; 8840.0700; 
  1.13            8840.0800; 8840.0900; 8840.1000; 8840.1100; 8840.1200; 
  1.14            and 8840.1300. 
  1.15  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.16     Section 1.  Minnesota Statutes 1996, section 160.292, 
  1.17  subdivision 5, is amended to read: 
  1.18     Subd. 5.  [NONFREEWAY TRUNK HIGHWAY.] "Nonfreeway trunk 
  1.19  highway" means all (1) roadways that are not designated freeways 
  1.20  and that have crossing traffic at grade intersections and (2) 
  1.21  bypasses of outstate municipalities that have interchanges at 
  1.22  intersections of trunk highways with local roads or with other 
  1.23  trunk highways. 
  1.24     Sec. 2.  Minnesota Statutes 1996, section 169.01, 
  1.25  subdivision 81, is amended to read: 
  1.26     Subd. 81.  [RESIDENTIAL ROADWAY.] Residential roadway means 
  1.27  a street or portion of a street that is less than one-quarter 
  1.28  mile in length and is functionally classified by the 
  1.29  commissioner of transportation as a local street by the road 
  1.30  authority having jurisdiction. 
  2.1      Sec. 3.  Minnesota Statutes 1996, section 169.01, is 
  2.2   amended by adding a subdivision to read: 
  2.3      Subd. 84.  [DAYTIME.] For purposes of regulating the 
  2.4   operation of a motor vehicle, "daytime" means the time from 
  2.5   one-half hour before sunrise to one-half hour after sunset. 
  2.6      Sec. 4.  Minnesota Statutes 1996, section 169.01, is 
  2.7   amended by adding a subdivision to read: 
  2.8      Subd. 85.  [NIGHTTIME.] For purposes of regulating the 
  2.9   operation of a motor vehicle, "nighttime" means the time from 
  2.10  one-half hour after sunset to one-half hour before sunrise. 
  2.11     Sec. 5.  Minnesota Statutes 1996, section 169.14, 
  2.12  subdivision 5d, is amended to read: 
  2.13     Subd. 5d.  [SPEED ZONING IN WORK ZONES; SURCHARGE.] (a) The 
  2.14  commissioner, on trunk highways and temporary trunk highways, 
  2.15  and local authorities, on streets and highways under their 
  2.16  jurisdiction, may authorize the use of reduced maximum speed 
  2.17  limits in highway work zones.  The commissioner or local 
  2.18  authority is not required to conduct an engineering and traffic 
  2.19  investigation before authorizing a reduced speed limit in a 
  2.20  highway work zone. 
  2.21     (b) The minimum highway work zone speed limit is 20 miles 
  2.22  per hour.  The work zone speed limit must not reduce the 
  2.23  established speed limit on the affected street or highway by 
  2.24  more than 15 miles per hour, except that the highway work zone 
  2.25  speed limit shall not exceed 40 miles per hour.  Highway work 
  2.26  zone speed limits are effective on erection of appropriate 
  2.27  regulatory speed limit signs.  The signs must be removed or 
  2.28  covered when they are not required.  A speed greater than the 
  2.29  posted highway work zone speed limit is unlawful.  
  2.30     (c) For purposes of this subdivision, "highway work zone" 
  2.31  means a segment of highway or street where a road authority or 
  2.32  its agent is constructing, reconstructing, or maintaining the 
  2.33  physical structure of the roadway, its shoulders, or features 
  2.34  adjacent to the roadway, including underground and overhead 
  2.35  utilities and highway appurtenances. 
  2.36     (d) Notwithstanding section 609.0331 or 609.101 or other 
  3.1   law to the contrary, a person who violates a speed limit 
  3.2   established under paragraph (b), or who violates any other 
  3.3   provision of this section or section 169.141 while in a highway 
  3.4   work zone, is assessed an additional surcharge equal to the 
  3.5   amount of the fine imposed for the speed violation, but not less 
  3.6   than $25. 
  3.7      Sec. 6.  [REPEALER.] 
  3.8      Minnesota Rules, parts 8840.0100; 8840.0200; 8840.0300; 
  3.9   8840.0400; 8840.0500; 8840.0600; 8840.0700; 8840.0800; 
  3.10  8840.0900; 8840.1000; 8840.1100; 8840.1200; and 8840.1300, are 
  3.11  repealed. 
  3.12     Sec. 7.  [EFFECTIVE DATE.] 
  3.13     Sections 1 to 6 are effective the day following final 
  3.14  enactment.
