  1.1                          A bill for an act 
  1.2             relating to soil and water conservation district 
  1.3             boards; providing that the office of soil and water 
  1.4             conservation district supervisor is compatible with 
  1.5             certain city and town offices; amending Minnesota 
  1.6             Statutes 1994, sections 103C.315, by adding a 
  1.7             subdivision; and 204B.06, subdivision 1. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1994, section 103C.315, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 6.  [COMPATIBLE OFFICES.] The office of soil and 
  1.12  water conservation district supervisor and the offices of mayor, 
  1.13  clerk, clerk-treasurer, or council member in a statutory or home 
  1.14  rule charter city of not more than 2,500 population contained in 
  1.15  whole or in part in the soil and water conservation district are 
  1.16  compatible offices and one person may hold both offices.  The 
  1.17  office of soil and water conservation district supervisor and 
  1.18  the office of town clerk or town supervisor in a town of not 
  1.19  more than 2,500 population contained in whole or in part in the 
  1.20  soil and water conservation district are compatible offices and 
  1.21  one person may hold both offices.  A person holding both offices 
  1.22  shall refrain from voting or taking any other formal action on 
  1.23  any matter coming before the soil and water conservation 
  1.24  district board or the city council or town board that has a 
  1.25  substantial effect on both the soil and water conservation 
  1.26  district and the city or town.  This subdivision does not apply 
  2.1   to an office located in a metropolitan county as that term is 
  2.2   defined in section 473.121, subdivision 4. 
  2.3      Sec. 2.  Minnesota Statutes 1994, section 204B.06, 
  2.4   subdivision 1, is amended to read: 
  2.5      Subdivision 1.  [FORM OF AFFIDAVIT.] An affidavit of 
  2.6   candidacy shall state the name of the office sought and shall 
  2.7   state that the candidate:  
  2.8      (a) Is an eligible voter; 
  2.9      (b) Has no other affidavit on file as a candidate for any 
  2.10  office at the same primary or next ensuing general election, 
  2.11  except that a candidate for soil and water conservation district 
  2.12  supervisor in a district located in a county that is not a 
  2.13  metropolitan county as that term is defined in section 473.121, 
  2.14  subdivision 4, may also have on file an affidavit of candidacy 
  2.15  for mayor or council member of a statutory or home rule charter 
  2.16  city of not more than 2,500 population contained in whole or in 
  2.17  part in the soil and water conservation district or for town 
  2.18  supervisor in a town of not more than 2,500 population contained 
  2.19  in whole or in part in the soil and water conservation district; 
  2.20  and 
  2.21     (c) Is, or will be on assuming the office, 21 years of age 
  2.22  or more, and will have maintained residence in the district from 
  2.23  which the candidate seeks election for 30 days before the 
  2.24  general election. 
  2.25     An affidavit of candidacy must include a statement that the 
  2.26  candidate's name as written on the affidavit for ballot 
  2.27  designation is the candidate's true name or the name by which 
  2.28  the candidate is commonly and generally known in the community. 
  2.29     An affidavit of candidacy for partisan office shall also 
  2.30  state the name of the candidate's political party or political 
  2.31  principle, stated in three words or less.  
  2.32     Sec. 3.  [EFFECTIVE DATE.] 
  2.33     This act is effective retroactively to January 1, 1995.
