  1.1                          A bill for an act 
  1.2             relating to state lands; authorizing the exchange and 
  1.3             private sale of certain tax-forfeited land that 
  1.4             borders public water in Cass county. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [PRIVATE SALE OF TAX-FORFEITED LAND BORDERING 
  1.7   PUBLIC WATER; CASS COUNTY.] 
  1.8      (a) Notwithstanding Minnesota Statutes, sections 92.45 and 
  1.9   282.018, subdivision 1, and the public sale provisions of 
  1.10  Minnesota Statutes, chapter 282, Cass county may sell by private 
  1.11  sale the tax-forfeited lands bordering public water that are 
  1.12  described in paragraph (c), under the remaining provisions of 
  1.13  Minnesota Statutes, chapter 282.  
  1.14     (b) The conveyances must be in a form approved by the 
  1.15  attorney general. 
  1.16     (c) The lands to be conveyed are located in Cass county and 
  1.17  are described as: 
  1.18     (1) the West Quarter of the West Half of the Southwest 
  1.19  Quarter of the Southeast Quarter, section 35, Township 141 
  1.20  North, Range 28 West; and 
  1.21     (2) Wilderness Park Estates and Wilderness Park Estates 
  1.22  Additions 1 through 9. 
  1.23     (d) The county has determined that the county's land 
  1.24  management interests would best be served if the lands were 
  1.25  returned to private ownership. 
  2.1      Sec. 2.  [EXCHANGE OF TAX-FORFEITED LAND BORDERING PUBLIC 
  2.2   WATERS; CASS COUNTY.] 
  2.3      (a) Notwithstanding Minnesota Statutes, sections 92.45, 
  2.4   94.342, subdivision 3, 282.018, subdivision 1, or other law to 
  2.5   the contrary, Cass county may exchange land bordering public 
  2.6   water that is described in paragraph (c) under the provisions of 
  2.7   Minnesota Statutes, section 94.344. 
  2.8      (b) The conveyance must be in a form approved by the 
  2.9   attorney general. 
  2.10     (c) The land that may be exchanged is located in Cass 
  2.11  county and is described as: 
  2.12     That part of Government Lot 2, Section 5, Township 140 
  2.13     North, Range 29 West, Cass county, Minnesota, described as 
  2.14     follows: 
  2.15     Beginning at the northwest corner of Lot 22, Block 1, 
  2.16     BROADWATER ESTATES, according to the record plat thereof, 
  2.17     on file in the office of the Cass county recorder; thence 
  2.18     South 1 degree 53 minutes 19 seconds East, bearing 
  2.19     assigned, on the west lines of said Lot 22, also being the 
  2.20     east line of said Government Lot 2, a distance of 86.46 
  2.21     feet; thence South 88 degrees 41 minutes 00 seconds West 
  2.22     151 feet, more or less, to intersect the shore of Woman 
  2.23     Lake; thence northeasterly on said shore to intersect the 
  2.24     east line of said Government Lot 2; thence South 1 degree 
  2.25     53 minutes 19 seconds East 255 feet, more or less, to the 
  2.26     point of beginning and there terminate. 
  2.27     Subject to reservations, restrictions, and easements of 
  2.28     record. 
  2.29     (d) The county has determined that the county's land 
  2.30  management interests would best be served if the land was 
  2.31  exchanged for a private parcel. 
  2.32     Sec. 3.  [EFFECTIVE DATE.] 
  2.33     Section 2 is effective the day following final enactment.
