  1.1                          A bill for an act 
  1.2             relating to human services licensing; modifying 
  1.3             requirements for location of adult foster care 
  1.4             programs; amending Minnesota Statutes 2002, section 
  1.5             245A.11, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 245A.11, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 4a.  [LOCATION OF ADULT FOSTER CARE 
  1.10  PROGRAMS.] Notwithstanding subdivision 4, in determining whether 
  1.11  to grant an adult foster care license, beginning July 1, 2003, 
  1.12  the commissioner shall not grant an initial license to any adult 
  1.13  foster care program if:  (1) the program will be within 1,320 
  1.14  feet of an existing adult foster care program; (2) the program 
  1.15  is located in a city of the first or second class; and (3) the 
  1.16  city in which the program will be located has a highly 
  1.17  concentrated population of adult foster care programs.  For 
  1.18  purposes of this subdivision, "highly concentrated" means that a 
  1.19  city of the first or second class has a population in adult 
  1.20  foster care programs, as measured by the number of adult foster 
  1.21  care beds per thousand population of the city, that is greater 
  1.22  than twice the average concentration of adult foster care beds 
  1.23  for all other cities of the first and second class combined.  
  1.24  This subdivision does not apply to adult foster care programs 
  1.25  licensed before July 1, 2003, that are located within 1,320 feet 
  2.1   of an existing adult foster care program.
