  1.1                          A bill for an act 
  1.2             relating to the Red River watershed management board; 
  1.3             changing the description of the area subject to 
  1.4             special authority of watershed districts; amending 
  1.5             Laws 1976, chapter 162, section 1, as amended.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Laws 1976, chapter 162, section 1, as amended 
  1.8   by Laws 1982, chapter 474, section 1, Laws 1983, chapter 338, 
  1.9   section 1, Laws 1989 First Special Session chapter 1, article 5, 
  1.10  section 45, and Laws 1991, chapter 167, section 1, is amended to 
  1.11  read: 
  1.12     Section 1.  [RED RIVER OF THE NORTH WATERSHED; TAX BY 
  1.13  WATERSHED DISTRICTS.] 
  1.14     Each watershed district located both within the counties of 
  1.15  Kittson, Marshall, Polk, Pennington, Red Lake, Norman, Clay, 
  1.16  Mahnomen, Clearwater, Roseau, Wilkin, Ottertail, Becker, 
  1.17  Koochiching, Beltrami, Traverse, Grant, Big Stone, Stevens, and 
  1.18  Itasca, which district and within the hydrologic basin of the 
  1.19  Red River of the North that is a member of the Red River 
  1.20  watershed management board, established by a joint powers 
  1.21  agreement in accordance with Minnesota Statutes, section 471.59, 
  1.22  may levy an ad valorem tax not to exceed 0.04836 percent of the 
  1.23  taxable market value of all property within the district.  This 
  1.24  levy shall be in excess of any levy authorized by Minnesota 
  1.25  Statutes, section 103D.905.  The proceeds of one-half of this 
  2.1   levy shall be credited to the district's construction fund and 
  2.2   shall be used for the development, construction, and maintenance 
  2.3   of projects and programs of benefit to the district.  The 
  2.4   proceeds of the remaining one-half of this levy shall be 
  2.5   credited to the general fund of the Red River watershed 
  2.6   management board and shall be used for funding the development, 
  2.7   construction, and maintenance of projects and programs of 
  2.8   benefit to the Red River basin.  The Red River management board 
  2.9   shall adopt criteria for member districts to follow in applying 
  2.10  for funding from the board. 
  2.11     Sec. 2.  [EFFECTIVE DATE.] 
  2.12     This act is effective the day after final enactment.
