  1.2             relating to crime prevention; defining the crime of 
  1.3             attempted manufacture of methamphetamine; prescribing 
  1.4             penalties; amending Minnesota Statutes 2002, section 
  1.5             152.021, subdivision 2a; repealing Minnesota Statutes 
  1.6             2002, section 152.135, subdivision 4. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 152.021, 
  1.9   subdivision 2a, is amended to read: 
  1.10     Subd. 2a.  [MANUFACTURE CRIMES.] (a) Notwithstanding 
  1.11  subdivision 1, sections 152.022, subdivision 1, 152.023, 
  1.12  subdivision 1, and 152.024, subdivision 1, a person is guilty of 
  1.13  controlled substance crime in the first degree if the person 
  1.14  manufactures any amount of methamphetamine. 
  1.15     (b) Notwithstanding section 609.17 and paragraph (a), a 
  1.16  person is guilty of attempted manufacture of methamphetamine if 
  1.17  the person possesses any chemical re-agents or precursors with 
  1.18  the intent to manufacture methamphetamine.  As used in this 
  1.19  section, "chemical re-agents or precursors" refers to one or 
  1.20  more of the following substances, or their salts, isomers, and 
  1.21  salts of isomers: 
  1.22     (1) Ephedrine; 
  1.23     (2) Pseudoephedrine; 
  1.24     (3) Phenyl-2-propanone; 
  1.25     (4) Phenylacetone; 
  1.26     (5) Anhydrous ammonia, as defined in Minnesota Statutes, 
  2.1   section 18C.005, subdivision 1a; 
  2.2      (6) Organic solvents; 
  2.3      (7) Hydrochloric acid; 
  2.4      (8) Lithium metal; 
  2.5      (9) Sodium metal; 
  2.6      (10) Ether; 
  2.7      (11) Sulfuric acid; 
  2.8      (12) Red phosphorous; 
  2.9      (13) Iodine; 
  2.10     (14) Sodium hydroxide; 
  2.11     (15) Benzaldehyde; 
  2.12     (16) Benzyl methyl ketone; 
  2.13     (17) Benzyl cyanide; 
  2.14     (18) Nitroethane; 
  2.15     (19) Methylamine; 
  2.16     (20) Phenylacetic acid; 
  2.17     (21) Hydriodic acid; or 
  2.18     (22) Hydriotic acid. 
  2.19     [EFFECTIVE DATE.] This section is effective for crimes 
  2.20  committed on or after August 1, 2003. 
  2.21     Sec. 2.  [REPEALER.] 
  2.22     Minnesota Statutes 2002, section 152.135, subdivision 4, is 
  2.23  repealed. 
  2.24     [EFFECTIVE DATE.] This section is effective for crimes 
  2.25  committed on or after August 1, 2003.
