  1.1                          A bill for an act
  1.2             relating to fire protection industry licensing; 
  1.3             requiring certification for installers of multipurpose 
  1.4             potable water piping systems; requiring licensing for 
  1.5             multipurpose potable water piping system contractors; 
  1.6             amending Minnesota Statutes 2002, sections 299M.01, by 
  1.7             adding subdivisions; 299M.03, by adding subdivisions; 
  1.8             299M.04; 299M.11, subdivisions 1, 2. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2002, section 299M.01, is 
  1.11  amended by adding a subdivision to read: 
  1.12     Subd. 8a.  [MULTIPURPOSE POTABLE WATER PIPING SYSTEM 
  1.13  CONTRACTOR.] "Multipurpose potable water piping system 
  1.14  contractor" means a person who contracts to sell, design, 
  1.15  install, modify, or inspect a multipurpose potable water piping 
  1.16  system, its parts, or related equipment. 
  1.17     Sec. 2.  Minnesota Statutes 2002, section 299M.01, is 
  1.18  amended by adding a subdivision to read: 
  1.19     Subd. 8b.  [MULTIPURPOSE POTABLE WATER PIPING 
  1.20  SYSTEM.] "Multipurpose potable water piping system" means a 
  1.21  potable water piping system that is intended to serve both 
  1.22  domestic and fire protection needs throughout a one- or 
  1.23  two-family dwelling unit.  No person may install a multipurpose 
  1.24  potable water piping system unless that person is licensed 
  1.25  pursuant to section 326.40 and is certified pursuant to section 
  1.26  299M.03. 
  1.27     Sec. 3.  Minnesota Statutes 2002, section 299M.01, is 
  2.1   amended by adding a subdivision to read: 
  2.2      Subd. 8c.  [MULTIPURPOSE POTABLE WATER PIPING SYSTEM 
  2.3   INSTALLER.] "Multipurpose potable water piping system installer" 
  2.4   means a person who is certified as competent to engage in 
  2.5   installing, connecting, altering, repairing, or adding to a 
  2.6   residential multipurpose potable water piping system in a one- 
  2.7   or two-family dwelling unit. 
  2.8      Sec. 4.  Minnesota Statutes 2002, section 299M.03, is 
  2.9   amended by adding a subdivision to read: 
  2.10     Subd. 1a.  [MULTIPURPOSE POTABLE WATER PIPING SYSTEM 
  2.11  CONTRACTOR LICENSE.] Except for residential installations by the 
  2.12  owner-occupant of a one- or two-family dwelling, a person may 
  2.13  not sell, design, install, modify, or inspect a multipurpose 
  2.14  potable water piping system, its parts, or related equipment, or 
  2.15  offer to do so, unless annually licensed to perform these duties 
  2.16  as a multipurpose potable water piping system contractor.  No 
  2.17  license is required under this section for a person licensed as 
  2.18  a professional engineer under section 326.03 who is competent in 
  2.19  fire protection system design. 
  2.20     Sec. 5.  Minnesota Statutes 2002, section 299M.03, is 
  2.21  amended by adding a subdivision to read: 
  2.22     Subd. 3.  [MULTIPURPOSE POTABLE WATER PIPING SYSTEM 
  2.23  INSTALLER CERTIFICATE.] Except for residential installations by 
  2.24  the owner-occupant of a one- or two-family dwelling, a person 
  2.25  may not install, connect, alter, repair, or add to a 
  2.26  multipurpose potable water piping system, unless annually 
  2.27  certified to perform these duties as a multipurpose potable 
  2.28  water piping system installer.  A multipurpose potable water 
  2.29  piping system installer certificate only allows the certificate 
  2.30  holder to work on one- and two-family residential units. 
  2.31     Sec. 6.  Minnesota Statutes 2002, section 299M.04, is 
  2.32  amended to read: 
  2.33     299M.04 [RULES, FEES, ORDERS, PENALTIES.] 
  2.34     The commissioner shall adopt permanent rules for operation 
  2.35  of the council; regulation by municipalities; qualifications, 
  2.36  examination, and licensing of fire protection contractors; 
  3.1   licensing of multipurpose potable water piping system 
  3.2   contractors; certification of multipurpose potable water piping 
  3.3   system installers; certification of journeyman sprinkler 
  3.4   fitters; registration of apprentices; and the administration and 
  3.5   enforcement of this chapter.  Permit fees must be a percentage 
  3.6   of the total cost of the fire protection work. 
  3.7      The commissioner may issue a cease and desist order to 
  3.8   cease an activity considered an immediate risk to public health 
  3.9   or public safety.  The commissioner shall adopt permanent rules 
  3.10  governing when an order may be issued; how long the order is 
  3.11  effective; notice requirements; and other procedures and 
  3.12  requirements necessary to implement, administer, and enforce the 
  3.13  provisions of this chapter.  
  3.14     The commissioner, in place of or in addition to licensing 
  3.15  sanctions allowed under this chapter, may impose a civil penalty 
  3.16  not greater than $1,000 for each violation of this chapter or 
  3.17  rule adopted under this chapter, for each day of violation.  The 
  3.18  commissioner shall adopt permanent rules governing and 
  3.19  establishing procedures for implementation, administration, and 
  3.20  enforcement of this paragraph.  
  3.21     Sec. 7.  Minnesota Statutes 2002, section 299M.11, 
  3.22  subdivision 1, is amended to read: 
  3.23     Subdivision 1.  [LICENSING FEE.] A person required to be 
  3.24  licensed under section 299M.03, subdivision 1 or 1a, shall, 
  3.25  before receipt of the license and before causing fire 
  3.26  protection-related work or multipurpose potable water piping 
  3.27  system work to be performed, pay the commissioner an annual 
  3.28  license fee. 
  3.29     Sec. 8.  Minnesota Statutes 2002, section 299M.11, 
  3.30  subdivision 2, is amended to read: 
  3.31     Subd. 2.  [CERTIFICATION FEE.] Employees required to be 
  3.32  certified under section 299M.03, subdivision 2 or 3, shall, 
  3.33  before performing fire protection-related work or multipurpose 
  3.34  potable water piping system work, pay the commissioner an annual 
  3.35  certification fee. 
  3.36     Sec. 9.  [EFFECTIVE DATE.] 
  4.1      Sections 1 to 8 are effective July 1, 2004.
