  1.1                          A bill for an act 
  1.2             relating to health; directing the commissioner of 
  1.3             health to exempt certain wading pools from the 
  1.4             requirements for public swimming pools. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [RULES REGULATING PUBLIC SWIMMING POOLS.] 
  1.7      (a) The commissioner of health shall amend Minnesota Rules, 
  1.8   part 4717.0250, subparts 7 and 8, to specify that the following 
  1.9   wading pools are private residential pools, and not public 
  1.10  pools, for purposes of public swimming pool regulation under 
  1.11  Minnesota Rules, chapter 4717: 
  1.12     (1) a wading pool operated at a family day care or group 
  1.13  family day care home that is licensed under Minnesota Rules, 
  1.14  chapter 9502; and 
  1.15     (2) a wading pool operated at a home at which child care 
  1.16  services are provided under Minnesota Statutes, section 245A.03, 
  1.17  subdivision 2, clause (2), or under Laws 1997, chapter 248, 
  1.18  section 46, including subsequent amendments. 
  1.19     (b) The amendments required by this section may be done in 
  1.20  the manner specified in Minnesota Statutes, section 14.388, 
  1.21  under the authority of clause (3) of that section. 
  1.22     Sec. 2.  [EFFECTIVE DATE.] 
  1.23     Section 1 is effective the day following final enactment.
