  1.1                             A resolution 
  1.2             memorializing Congress of ratification of a proposed 
  1.3             amendment to the Constitution of the United States of 
  1.4             America relating to balancing the budget of the United 
  1.5             States. 
  1.6      
  1.7      WHEREAS, both Houses of the Congress of the United States 
  1.8   by a Joint Resolution have proposed an amendment to the 
  1.9   Constitution of the United States that reads as follows: 
  1.10     Resolved by the Senate and House of Representatives of the 
  1.11  United States of America in Congress assembled (two-thirds of 
  1.12  each House concurring therein), That the following article is 
  1.13  proposed as an amendment to the Constitution of the United 
  1.14  States, which shall be valid to all intents and purposes as part 
  1.15  of the Constitution when ratified by the legislatures of 
  1.16  three-fourths of the several States within seven years after the 
  1.17  date of its submission for ratification: 
  1.18                            "ARTICLE ..
  1.19     "Section 1.  Total outlays for any fiscal year shall not 
  1.20  exceed total receipts for that fiscal year, unless three-fifths 
  1.21  of the whole number of each House of Congress shall provide by 
  1.22  law for a specific excess of outlays over receipts by a rollcall 
  1.23  vote. 
  1.24     "Section 2.  The limit on the debt of the United States 
  1.25  held by the public shall not be increased, unless three-fifths 
  2.1   of the whole number of each House shall provide by law for such 
  2.2   an increase by a rollcall vote. 
  2.3      "Section 3.  Prior to each fiscal year, the President shall 
  2.4   transmit to the Congress a proposed budget for the United States 
  2.5   Government for that fiscal year, in which total outlays do not 
  2.6   exceed total receipts. 
  2.7      "Section 4.  No bill to increase revenue shall become law 
  2.8   unless approved by a majority of the whole number of each House 
  2.9   by a rollcall vote. 
  2.10     "Section 5.  The Congress may waive the provisions of this 
  2.11  article for any fiscal year in which a declaration of war is in 
  2.12  effect.  The provisions of this article may be waived for any 
  2.13  fiscal year in which the United States is engaged in military 
  2.14  conflict which causes an imminent and serious military threat to 
  2.15  national security and is so declared by a joint resolution, 
  2.16  adopted by a majority of the whole number of each House, which 
  2.17  becomes law. 
  2.18     "Section 6.  The Congress shall enforce and implement this 
  2.19  article by appropriate legislation, which may rely on estimates 
  2.20  of outlays and receipts. 
  2.21     "Section 7.  Total receipts shall include all receipts of 
  2.22  the United States Government except those derived from borrowing.
  2.23  Total outlays shall include all outlays of the United States 
  2.24  Government except for those for repayment of debt principal. 
  2.25     "Section 8.  This article shall take effect beginning with 
  2.26  fiscal year 2002 or with the second fiscal year beginning after 
  2.27  its ratification, whichever is later."; NOW, THEREFORE, 
  2.28     BE IT RESOLVED by the Legislature of the State of Minnesota 
  2.29  that the proposed amendment to the Constitution of the United 
  2.30  States is hereby ratified by the Legislature of the State of 
  2.31  Minnesota. 
  2.32     BE IT FURTHER RESOLVED that the Secretary of State of the 
  2.33  State of Minnesota shall prepare certified copies of this 
  2.34  memorial and transmit them to the Administrator of the General 
  2.35  Services Administration.
