  1.1                          A bill for an act 
  1.2             relating to utilities; clarifying requirement for 
  1.3             electric energy installed capacity generated by wind 
  1.4             energy conversion systems; amending Minnesota Statutes 
  1.5             1998, section 216B.2423, subdivisions 1 and 2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 216B.2423, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [MANDATE.] A public utility, as defined in 
  1.10  section 216B.02, subdivision 4, that operates a nuclear-powered 
  1.11  electric generating plant within this state must construct and 
  1.12  operate, purchase, or contract to construct and operate:  (1) 
  1.13  225 megawatts of electric energy installed capacity generated by 
  1.14  wind energy conversion systems within the state by December 31, 
  1.15  1998; and (2) an additional 200 megawatts of installed 
  1.16  capacity so generated by wind energy conversion systems within 
  1.17  the state by December 31, 2002. 
  1.18     For the purpose of this section, "wind energy conversion 
  1.19  system" has the meaning given it in section 216C.06, subdivision 
  1.20  12. 
  1.21     Sec. 2.  Minnesota Statutes 1998, section 216B.2423, 
  1.22  subdivision 2, is amended to read: 
  1.23     Subd. 2.  [RESOURCE PLANNING MANDATE.] The public utilities 
  1.24  commission shall order a public utility subject to subdivision 
  1.25  1, to construct and operate, purchase, or contract to purchase 
  2.1   an additional 400 megawatts of electric energy installed 
  2.2   capacity generated by wind energy conversion systems within the 
  2.3   state by December 31, 2002, subject to resource planning and 
  2.4   least cost planning requirements in section 216B.2422. 
  2.5      Sec. 3.  [EFFECTIVE DATE.] 
  2.6      Sections 1 and 2 are effective the day following final 
  2.7   enactment.
