  1.1                          A bill for an act 
  1.2             relating to state parks; adding to state parks; 
  1.3             renaming O.L. Kipp state park; permitting liquor sales 
  1.4             in certain parks; authorizing the commissioner to 
  1.5             contract out certain restaurant services; permitting a 
  1.6             land sale in St. Louis county; providing for entry to 
  1.7             Tettegouche state park; amending Minnesota Statutes 
  1.8             1996, sections 85.012, by adding a subdivision; and 
  1.9             85.0505; repealing Minnesota Statutes 1996, section 
  1.10            85.012, subdivision 46. 
  1.11  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.12     Section 1.  Minnesota Statutes 1996, section 85.012, is 
  1.13  amended by adding a subdivision to read: 
  1.14     Subd. 24a.  Great River Bluffs state park, Winona county, 
  1.15  which is renamed from O.L. Kipp state park. 
  1.16     Sec. 2.  Minnesota Statutes 1996, section 85.0505, is 
  1.17  amended to read: 
  1.18     85.0505 [SALE OF WINE AT DOUGLAS LODGE IN ITASCA STATE PARK 
  1.19  FOOD AND BEVERAGE SERVICE IN STATE PARKS.] 
  1.20     Subdivision 1.  [ITASCA STATE PARK.] Minnesota produced 
  1.21  wine and beer may be sold and consumed by the drink at the 
  1.22  restaurant in Douglas Lodge in Itasca State Park, subject to 
  1.23  other laws relating to the sale of intoxicating liquor. 
  1.24     Subd. 2.  [JOHN A. LATSCH STATE PARK.] (a) Liquor may be 
  1.25  sold and consumed by the drink at the restaurant in John A. 
  1.26  Latsch state park, subject to other laws relating to the sale of 
  1.27  intoxicating liquor, and provided that the restaurant is 
  1.28  operated by a private entity as provided in paragraph (b). 
  2.1      (b) The commissioner of natural resources may contract with 
  2.2   a private person, firm, or corporation to operate the restaurant 
  2.3   in John A. Latsch state park. 
  2.4      Sec. 3.  Minnesota Statutes 1996, section 85.054, is 
  2.5   amended by adding a subdivision to read: 
  2.6      Subd. 7.  [TETTEGOUCHE STATE PARK.] A state park permit is 
  2.7   not required and a fee may not be charged for motor vehicle 
  2.8   entry at Palisade Head in Tettegouche state park, provided that 
  2.9   motor vehicles entering the park under this provision may not be 
  2.10  parked at Palisade Head for more than one hour. 
  2.11     Sec. 4.  [ADDITIONS TO STATE PARKS.] 
  2.12     Subdivision 1.  [85.012] [Subd. 4.] [BEAR HEAD LAKE STATE 
  2.13  PARK, ST. LOUIS COUNTY.] The following areas are added to Bear 
  2.14  Head Lake state park, all in St. Louis county, Minnesota: 
  2.15     (1) Outlot A in the plat of Swanson Shores in Section 34, 
  2.16  Township 62 North, Range 14 West; and 
  2.17     (2) Government Lots 1 and 2, Section 3, Township 61 North, 
  2.18  Range 14 West. 
  2.19     Subd. 2.  [85.012] [Subd. 19.] [FORESTVILLE STATE PARK, 
  2.20  FILLMORE COUNTY.] The following area is added to Forestville 
  2.21  state park:  the Northeast Quarter of the Northeast Quarter of 
  2.22  Section 23, Township 102 North, Range 12 West, Fillmore county, 
  2.23  Minnesota. 
  2.24     The commissioner shall manage this addition as a state park 
  2.25  as provided in section 86A.05, subdivision 3, but in addition to 
  2.26  other activities authorized in Forestville state park shall 
  2.27  allow hunting. 
  2.28     Subd. 3.  [85.012] [Subd. 30a.] [JOHN LATSCH STATE PARK, 
  2.29  WINONA COUNTY.] The following areas are added to John Latsch 
  2.30  state park, all in Township 108 North, Range 8 West, Winona 
  2.31  county, Minnesota: 
  2.32     (1) Government Lot 1, Section 16; 
  2.33     (2) that part of Government Lots 1 and 2, Section 17, lying 
  2.34  north and east of the right-of-way of the Chicago, Milwaukee, St.
  2.35  Paul, and Pacific Railroad Company; and 
  2.36     (3) that part of the East Half of Government Lot 3, Section 
  3.1   17, lying north and east of a line 35 feet riverward and 
  3.2   parallel with the centerline of the Chicago, Milwaukee, St. 
  3.3   Paul, and Pacific Railroad Company's riverward track, excepting 
  3.4   therefrom that part of the East Half of Government Lot 3 
  3.5   acquired as tract Wi-1 by the United States Government on 
  3.6   January 6, 1936, by condemnation. 
  3.7      Subd. 4.  [85.012] [Subd. 54.] [SPLIT ROCK LIGHTHOUSE STATE 
  3.8   PARK.] The following areas are added to Split Rock Lighthouse 
  3.9   state park: 
  3.10     (1) Outlot 4 of Government Lot 2; and 
  3.11     (2) Government Lot 1, Section 33, Township 55 North of 
  3.12  Range 8 West of the Fourth Principal Meridian, according to the 
  3.13  United States Government survey thereof, except that part 
  3.14  described as follows: 
  3.15     (i) that part of said premises shown as Parcel 1142 on 
  3.16  Minnesota Department of Transportation Right of Way Plat 
  3.17  Numbered 38-1 filed in the office of the Registrar of Titles, 
  3.18  Lake County, Minnesota, as Document No. 111,156. 
  3.19     Those lands in Government Lot 1 North and West of Highway 
  3.20  61 shall remain open to hunting and other recreational uses as 
  3.21  approved in the park management plan. 
  3.22     Sec. 5.  [PRIVATE SALE OF TAX-FORFEITED LAND; ST. LOUIS 
  3.23  COUNTY.] 
  3.24     (a) Notwithstanding Minnesota Statutes, sections 92.45 and 
  3.25  282.018, subdivision 1, and the public sale provisions of 
  3.26  Minnesota Statutes, chapter 282, St. Louis county may sell the 
  3.27  land in St. Louis county described in this section by private 
  3.28  sale under the remaining provisions of chapter 282. 
  3.29     (b) The conveyance must be in a form approved by the 
  3.30  attorney general and must reserve an easement for the state, in 
  3.31  a form prescribed by the commissioner of natural resources, for 
  3.32  the land within 66 feet of either side of the center line of 
  3.33  Amity creek for angling and fish management purposes, and rights 
  3.34  of access to the easement for the commissioner by a reasonable 
  3.35  route across the parcels of land. 
  3.36     (c) The parcels of land that may be sold are described as: 
  4.1      (1) City of Duluth:  that part of the Northeast Quarter of 
  4.2   the Northeast Quarter of the Northwest 1/4 lying north of the 
  4.3   center line of Amity creek, Section 31, Township 51, Range 13; 
  4.4   and 
  4.5      (2) City of Duluth:  that part of the North 1/2 of the 
  4.6   Northwest 1/4 of the Northwest 1/4 of Northeast 1/4 lying north 
  4.7   of the center line of Amity creek and within 220 feet of the 
  4.8   west line of the said Northwest 1/4 of the Northeast 1/4, 
  4.9   Section 31, Township 51, Range 13. 
  4.10     (d) The county has determined that the county's land 
  4.11  management interests would best be served if the lands were 
  4.12  returned to private ownership. 
  4.13     Sec. 6.  [REPEALER.] 
  4.14     Minnesota Statutes 1996, section 85.012, subdivision 46, is 
  4.15  repealed.
