  1.1                          A bill for an act 
  1.2             relating to disasters; providing for aid to political 
  1.3             subdivisions for certain extraordinary disaster 
  1.4             expenses; appropriating money; proposing coding for 
  1.5             new law in Minnesota Statutes, chapter 12. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [12.38] [AID FOR EXTRAORDINARY LOCAL DISASTER 
  1.8   EXPENSES.] 
  1.9      Subdivision 1.  [ELIGIBILITY.] (a) A political subdivision 
  1.10  as defined in section 12.03, subdivision 9, that meets the 
  1.11  eligibility requirements of this subdivision may apply for and 
  1.12  receive state aid for necessary extraordinary expenses incurred 
  1.13  or to be incurred because of a natural or other disaster defined 
  1.14  in section 12.03, subdivision 2. 
  1.15     (b) The eligibility requirements are: 
  1.16     (1) the governor must declare that the disaster is subject 
  1.17  to this section; 
  1.18     (2) the political subdivision or part of it must be within 
  1.19  the area of the governor's declaration; 
  1.20     (3) the expenses must be necessitated by the disaster 
  1.21  referred to in the declaration and spent for that disaster's 
  1.22  effect within the declared disaster area that is within the 
  1.23  political subdivision; 
  1.24     (4) the expenses must be for effects arising during a 
  1.25  defined period of time or in a defined incident referred to in 
  2.1   the governor's declaration; 
  2.2      (5) the expenses must not be eligible for federal disaster 
  2.3   assistance, of any kind, if any; 
  2.4      (6) extraordinary expenses, unreimbursed from any other 
  2.5   source, must exceed five percent of the gross tax levy of the 
  2.6   political subdivision for the political subdivision's tax year 
  2.7   in which the eligible expenses are incurred or to be incurred; 
  2.8   and 
  2.9      (7) the expenses must be for a public purpose. 
  2.10     Subd. 2.  [MATCHING REQUIREMENT.] The state must pay up to 
  2.11  75 percent of eligible expenses under subdivision 1, subject to 
  2.12  a commitment, determined by the commissioner to be satisfactory, 
  2.13  that the political subdivision will make a contribution in a 
  2.14  proportion of three state dollars to one nonstate dollar.  The 
  2.15  nonstate portion may include in kind contributions.  
  2.16     Subd. 3.  [APPLYING AND ACCOUNTING FOR AID; PAYMENTS.] The 
  2.17  commissioner must establish procedures for political 
  2.18  subdivisions to apply and account for aid under this section.  
  2.19  The commissioner must make payments under this section in 
  2.20  installments commensurate with fulfillment of a political 
  2.21  subdivision's matching requirements. 
  2.22     Sec. 2.  [12.39] [APPROPRIATION.] 
  2.23     The amount necessary, up to $......., is appropriated 
  2.24  annually to the commissioner of public safety for the purposes 
  2.25  of section 1.  State payments under section 1 must be prorated 
  2.26  as necessary so as not to exceed the limit in this section.
