  1.1                          A bill for an act 
  1.2             relating to motor vehicles; allowing license plates 
  1.3             for collector vehicles to be transferred and reissued; 
  1.4             imposing fees; amending Minnesota Statutes 1994, 
  1.5             section 168.10, subdivisions 1a, 1b, 1c, 1d, 1h, 3, 
  1.6             and by adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 168.10, 
  1.9   subdivision 1a, is amended to read: 
  1.10     Subd. 1a.  [COLLECTOR'S VEHICLE, PIONEER LICENSE.] Any 
  1.11  motor vehicle manufactured prior to 1936 and owned and operated 
  1.12  solely as a collector's item shall be listed for taxation and 
  1.13  registration as follows:  An affidavit shall be executed stating 
  1.14  the name and address of the owner, the name and address of the 
  1.15  person from whom purchased, the make of the motor vehicle, year 
  1.16  and number of the model, the manufacturer's identification 
  1.17  number and that the vehicle is owned and operated solely as a 
  1.18  collector's item and not for general transportation purposes.  
  1.19  If the registrar is satisfied that the affidavit is true and 
  1.20  correct and the owner pays a $25 tax, the registrar shall list 
  1.21  such vehicle for taxation and registration and shall issue 
  1.22  number plates. 
  1.23     The number plates so issued shall bear the inscription 
  1.24  "Pioneer," "Minnesota" and the registration number or other 
  1.25  combination of characters authorized under section 168.12, 
  1.26  subdivision 2a, but no date.  The number plates are valid 
  2.1   without renewal as long as the vehicle is in existence and shall 
  2.2   be issued for the applicant's use only for such vehicle.  The 
  2.3   registrar has the power to revoke said plates for failure to 
  2.4   comply with this subdivision. 
  2.5      Sec. 2.  Minnesota Statutes 1994, section 168.10, 
  2.6   subdivision 1b, is amended to read: 
  2.7      Subd. 1b.  [COLLECTOR'S VEHICLE, CLASSIC CAR LICENSE.] Any 
  2.8   motor vehicle manufactured between and including the years 1925 
  2.9   and 1948, and designated by the registrar of motor vehicles as a 
  2.10  classic car because of its fine design, high engineering 
  2.11  standards, and superior workmanship, and owned and operated 
  2.12  solely as a collector's item shall be listed for taxation and 
  2.13  registration as follows:  An affidavit shall be executed stating 
  2.14  the name and address of the owner, the name and address of the 
  2.15  person from whom purchased, the make of the motor vehicle, year 
  2.16  and number of the model, the manufacturer's identification 
  2.17  number and that the vehicle is owned and operated solely as a 
  2.18  collector's item and not for general transportation purposes.  
  2.19  If the registrar is satisfied that the affidavit is true and 
  2.20  correct and that the motor vehicle qualifies to be classified as 
  2.21  a classic car, and the owner pays a $25 tax, the registrar shall 
  2.22  list such vehicle for taxation and registration and shall issue 
  2.23  number plates. 
  2.24     The number plates so issued shall bear the inscription 
  2.25  "Classic Car," "Minnesota," and the registration number or other 
  2.26  combination of characters authorized under section 168.12, 
  2.27  subdivision 2a, but no date.  The number plates are valid 
  2.28  without renewal as long as the vehicle is in existence and shall 
  2.29  be issued for the applicant's use only for such vehicle.  The 
  2.30  registrar has the power to revoke said plates for failure to 
  2.31  comply with this subdivision.

  6.23     Sec. 3.  Minnesota Statutes 1994, section 168.10, 
  6.24  subdivision 1c, is amended to read: 
  6.25     Subd. 1c.  [COLLECTOR'S VEHICLE, COLLECTOR LICENSE.] Any 
  6.26  motor vehicle, including any truck, that is at least 20 model 
  6.27  years old and manufactured after 1935, or any motor vehicle of a 
  6.28  defunct make defined as any car or truck originally licensed as 
  6.29  a separate identifiable make as designated by the division of 
  6.30  motor vehicles, and owned and operated solely as a collector's 
  6.31  vehicle, shall be listed for taxation and registration as 
  6.32  follows:  An affidavit shall be executed stating the name and 
  6.33  address of the person from whom purchased and of the new owner, 
  6.34  the make of the motor vehicle, year and number of the model, the 
  6.35  manufacturer's identification number and that the vehicle is 
  6.36  owned and operated solely as a collector's item and not for 
  7.1   general transportation purposes.  The owner must also prove that 
  7.2   the owner also has one or more vehicles with regular license 
  7.3   plates.  If the registrar is satisfied that the affidavit is 
  7.4   true and correct and the owner pays a $25 tax, the registrar 
  7.5   shall list the vehicle for taxation and registration and shall 
  7.6   issue number plates. 
  7.7      The number plates issued shall bear the inscription 
  7.8   "Collector," "Minnesota" and the registration number or other 
  7.9   combination of characters authorized under section 168.12, 
  7.10  subdivision 2a, but no date.  The number plates are valid 
  7.11  without renewal as long as the vehicle is in existence and shall 
  7.12  be issued for the applicant's use only for the vehicle.  The 
  7.13  registrar has the power to revoke the plates for failure to 
  7.14  comply with this subdivision. 
  7.15     Sec. 4.  Minnesota Statutes 1994, section 168.10, 
  7.16  subdivision 1d, is amended to read: 
  7.17     Subd. 1d.  [COLLECTOR'S VEHICLE, STREET ROD LICENSE.] Any 
  7.18  modernized motor vehicle manufactured prior to the year 1949 or 
  7.19  designed and manufactured to resemble such vehicle shall be 
  7.20  listed for taxation and registration as follows:  
  7.21     An affidavit shall be executed stating the name and address 
  7.22  of the person from whom purchased and of the new owner, the make 
  7.23  of the motor vehicle, year number of model, and the 
  7.24  manufacturer's identification number.  The affidavit shall 
  7.25  further state that the vehicle is owned and operated solely as a 
  7.26  street rod and not for general transportation purposes.  The 
  7.27  owner must also prove that the owner has one or more vehicles 
  7.28  with regular license plates.  If the registrar is satisfied that 
  7.29  the affidavit is true and correct and the owner pays a $25 tax, 
  7.30  the registrar shall list such vehicle for taxation and 
  7.31  registration and shall issue number plates.  
  7.32     The number plates issued shall bear the inscription "Street 
  7.33  Rod", "Minnesota" and the registration number or other 
  7.34  combination of characters authorized under section 168.12, 
  7.35  subdivision 2a, but no date.  The number plates are valid 
  7.36  without renewal as long as the vehicle is in existence and shall 
  8.1   be issued for the applicant's use only for such vehicle.  The 
  8.2   registrar has the power to revoke such plates for failure to 
  8.3   comply with this subdivision.  
  8.4      Sec. 5.  Minnesota Statutes 1994, section 168.10, 
  8.5   subdivision 1h, is amended to read: 
  8.6      Subd. 1h.  [COLLECTOR MILITARY VEHICLES.] (a) A motor 
  8.7   vehicle, including a truck, shall be listed and registered under 
  8.8   this section if it meets the following conditions: 
  8.9      (1) it is at least 20 years old; 
  8.10     (2) its first owner following its manufacture was a branch 
  8.11  of the armed forces of the United States and it presently 
  8.12  conforms to the vehicle specifications required during the time 
  8.13  of military ownership, or it has been restored and presently 
  8.14  conforms to the specifications required by a branch of the armed 
  8.15  forces for the model year that the restored vehicle could have 
  8.16  been owned by that branch of the armed forces; and 
  8.17     (3) it is owned by a nonprofit organization and operated 
  8.18  solely as a collector's vehicle.  For purposes of this 
  8.19  subdivision, "nonprofit organization" means a corporation, 
  8.20  society, association, foundation, or institution organized and 
  8.21  operated exclusively for historical or educational purposes, no 
  8.22  part of the net earnings of which inures to the benefit of a 
  8.23  private individual.  
  8.24     (b) The owner of the vehicle shall execute an affidavit 
  8.25  stating the name and address of the person from whom purchased 
  8.26  and of the new owner; the make, year, and model number of the 
  8.27  motor vehicle; the manufacturer's identification number; and the 
  8.28  collector military vehicle identification number, if any, 
  8.29  located on the exterior of the vehicle.  The affidavit must 
  8.30  affirm that the vehicle is owned by a nonprofit organization and 
  8.31  is operated solely as a collector's item and not for general 
  8.32  transportation purposes.  If the registrar is satisfied that the 
  8.33  affidavit is true and correct and the owner pays a $25 tax, the 
  8.34  registrar shall list the vehicle for taxation and registration 
  8.35  and shall issue number plates.  The number plates shall bear the 
  8.36  inscriptions "Collector" and "Minnesota" and the registration 
  9.1   number, but no date.  The number plates are valid without 
  9.2   renewal as long as the vehicle is in existence and may not be 
  9.3   transferred to another vehicle.  The registrar may revoke the 
  9.4   plates for failure to comply with this subdivision. 
  9.5      (c) Notwithstanding section 168.09, 168.12, or other law to 
  9.6   the contrary, the owner of a registered collector military 
  9.7   vehicle is not required to display registration plates on the 
  9.8   exterior of the vehicle if the vehicle has an exterior number 
  9.9   identification that conforms to the identifying system for 
  9.10  military vehicles in effect when the vehicle was last owned by 
  9.11  the branch of the armed forces of the United States or in effect 
  9.12  in the year to which the collector military vehicle has been 
  9.13  restored.  However, the state registration plates must be 
  9.14  carried in or on the collector military vehicle at all times. 
  9.15     (d) The owner of a registered collector military vehicle 
  9.16  that is not required to display registration plates under 
  9.17  paragraph (c) may tow a registered trailer behind it.  The 
  9.18  trailer is not required to display registration plates if the 
  9.19  trailer: 
  9.20     (1) does not exceed a gross weight of 15,000 pounds; 
  9.21     (2) otherwise conforms to registration, licensing, and 
  9.22  safety laws and specifications; 
  9.23     (3) conforms to military specifications for appearance and 
  9.24  identification; 
  9.25     (4) is intended to represent and does represent a military 
  9.26  trailer; and 
  9.27     (5) carries registration plates on or in the trailer or the 
  9.28  collector military vehicle towing the trailer. 
  9.29     Sec. 6.  Minnesota Statutes 1994, section 168.10, is 
  9.30  amended by adding a subdivision to read: 
  9.31     Subd. 1i.  [COLLECTOR PLATE TRANSFERS.] Notwithstanding 
  9.32  section 168.12, subdivision 1, on payment of a transfer fee of 
  9.33  $5, plates issued under this section may be transferred to 
  9.34  another vehicle owned or jointly owned by the person to whom the 
  9.35  special plates were issued or the plate may be assigned to 
  9.36  another owner.  In addition to the transfer fee a new owner must 
 10.1   pay the $25 plate fee or any fee required by section 168.12, 
 10.2   subdivision 2a.  The $5 fee must be paid into the state treasury 
 10.3   and credited to the highway user tax distribution fund.  License 
 10.4   plates issued under this section may not be transferred to a 
 10.5   vehicle not eligible for the collector's vehicle license plates. 
 10.6      Sec. 7.  Minnesota Statutes 1994, section 168.10, 
 10.7   subdivision 3, is amended to read: 
 10.8      Subd. 3.  [OFFENSES.] It shall be unlawful for any person: 
 10.9      (1) To display or cause to be displayed or to possess any 
 10.10  canceled, revoked, suspended or fraudulently obtained or stolen 
 10.11  registration plates; 
 10.12     (2) To lend the person's registration plates to another or 
 10.13  knowingly to permit the use thereof by another; 
 10.14     (3) To display or represent as the person's own any 
 10.15  registration plates not issued to that person; provided, 
 10.16  however, this shall not apply to any legal change of ownership 
 10.17  of the motor vehicle to which the plates are attached, nor shall 
 10.18  this apply to any transfer of collector plates under subdivision 
 10.19  1i; 
 10.20     (4) To fail or refuse to surrender to the department upon 
 10.21  its lawful demand any registration plates which have been 
 10.22  revoked, canceled, or suspended by proper authority; 
 10.23     (5) To use a false or fictitious name or address or 
 10.24  description of the motor vehicle, identification number, or 
 10.25  serial number in any application for registration of a motor 
 10.26  vehicle or to knowingly make a false statement or to knowingly 
 10.27  conceal a material fact or otherwise commit a fraud in any such 
 10.28  application; 
 10.29     (6) To destroy, alter, remove, cover or deface the 
 10.30  identification or serial number of any motor vehicle or to 
 10.31  knowingly operate any motor vehicle the identification or serial 
 10.32  number of which has been destroyed, altered, removed, covered or 
 10.33  defaced without first making application for assignment of a 
 10.34  special identification number as provided by law.
