  1.1                          A bill for an act 
  1.2             relating to peace officers; authorizing the state fair 
  1.3             police department to employ more part-time peace 
  1.4             officers; amending Minnesota Statutes 2002, section 
  1.5             626.8468, subdivision 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 626.8468, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [CAP ON NUMBER OF PART-TIME PEACE OFFICERS 
  1.10  PER AGENCY.] (a) A law enforcement agency that employed a 
  1.11  licensed part-time peace officer or that was in the process of 
  1.12  training an individual to become a licensed part-time peace 
  1.13  officer on or before February 1, 1999, may continue to do so.  
  1.14  No agency may employ more part-time peace officers than it 
  1.15  employed in calendar year 1996, 1997, or 1998, except the state 
  1.16  fair police department may employ up to 15 licensed part-time 
  1.17  peace officers. 
  1.18     (b) After January 1, 2000, the board may issue additional 
  1.19  part-time peace officer licenses to a law enforcement agency 
  1.20  that employs a part-time peace officer and that demonstrates to 
  1.21  the board an extraordinary and temporary need for the additional 
  1.22  license. 
  1.23     (c) If a local unit of government dissolves a law 
  1.24  enforcement agency that employs a part-time peace officer 
  1.25  authorized under this subdivision and contracts with another law 
  2.1   enforcement agency to provide law enforcement services, the law 
  2.2   enforcement agency contracted with may add that number of 
  2.3   part-time positions to the agency's maximum under this 
  2.4   subdivision if the agency hires or offers employment to all 
  2.5   full-time peace officers employed by the dissolved agency at the 
  2.6   time of dissolution.  The employment offered must be of 
  2.7   comparable responsibility and salary. 
  2.8      Sec. 2.  [EFFECTIVE DATE.] 
  2.9      Section 1 is effective the day following final enactment.
