  1.1                          A bill for an act 
  1.2             relating to education; reinstating funding for summer 
  1.3             school; appropriating money; amending Minnesota 
  1.4             Statutes 1998, section 126C.05, by adding a 
  1.5             subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 126C.05, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 18.  [BASIC SKILLS SUMMER SCHOOL PUPIL UNITS.] When a 
  1.10  pupil who has not passed an assessment of basic standards in 
  1.11  reading, writing, or mathematics is enrolled in a mastery of 
  1.12  basic skills summer school program that is not a part of the 
  1.13  regular school term and the student has a total enrollment time 
  1.14  of more than 1,020 hours in a school year, the pupil may be 
  1.15  counted as more than one pupil in average daily membership for 
  1.16  purposes of this subdivision only.  The amount in excess of one 
  1.17  pupil must be determined by the ratio of the number of hours of 
  1.18  instruction provided to that pupil in excess of 1,020 hours.  
  1.19  For each pupil, only the amount of summer school enrollment time 
  1.20  attributable to basic skills instruction may be used to 
  1.21  calculate the additional hours in the school year.  Basic skills 
  1.22  instruction is defined as in Minnesota's rules on graduation 
  1.23  standards and includes reading, writing, and mathematics.  Hours 
  1.24  that occur after the close of the instructional year in June are 
  1.25  attributable to the following fiscal year.  A pupil for whom 
  2.1   payment is made under this subdivision may be counted by a 
  2.2   district only for the computation of basic revenue, according to 
  2.3   section 126C.10, subdivision 2. 
  2.4      Sec. 2.  [APPROPRIATION.] 
  2.5      The following sums are appropriated in the fiscal years 
  2.6   designated from the general fund to the department of children, 
  2.7   families, and learning for summer school aid under section 1: 
  2.8        $.......     .....     2000

  2.10     Sec. 3.  [EFFECTIVE DATE.] 
  2.11     Sections 1 and 2 are effective the day following final 
  2.12  enactment and apply to revenue for summer programs offered 
  2.13  during 1999 and later.
