  1.1                          A bill for an act 
  1.2             relating to water; restricting the use of phosphorus 
  1.3             in dishwashers and detergents; amending Minnesota 
  1.4             Statutes 2002, section 116.23. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2002, section 116.23, is 
  1.7   amended to read: 
  1.8      116.23 [PROHIBITION AND RESTRICTIONS.] 
  1.9      Subdivision 1.  [NUTRIENT CONCENTRATION.] No person shall 
  1.10  manufacture for use or sale in Minnesota or import into 
  1.11  Minnesota for resale any cleaning agent or chemical water 
  1.12  conditioner which contains a prescribed nutrient in a 
  1.13  concentration that is greater than the prescribed maximum 
  1.14  permissible concentration of that nutrient in that cleaning 
  1.15  agent or chemical water conditioner.  
  1.16     Subd. 2.  [RESIDENTIAL DISHWASHING DETERGENT.] (a) No 
  1.17  household dishwashing detergent may be used or sold in the state 
  1.18  that contains more than 0.5 percent phosphorus by weight. 
  1.19     (b) No person may manufacture for use or sale in Minnesota, 
  1.20  or import into the state for resale, any dishwasher detergent 
  1.21  for commercial use that contains more than 8.7 percent 
  1.22  phosphorus by weight. 
  1.23     Subd. 3.  [COMMERCIAL AND INSTITUTIONAL DISHWASHER 
  1.24  RESTRICTIONS.] (a) All commercial and institutional dishwashers 
  1.25  sold in Minnesota after August 1, 2005, must be designed to use 
  2.1   a nonphosphorous dishwasher detergent and still comply with 
  2.2   state health standards. 
  2.3      (b) By January 1, 2007, all commercial and institutional 
  2.4   dishwashers used in the state must use only nonphosphorous 
  2.5   detergents.
