  1.1                          A bill for an act 
  1.2             relating to the environment; automobile emissions; 
  1.3             providing that a vehicle need not be inspected until 
  1.4             the year of its registration is five years more than 
  1.5             its model year; changing the inspection fee; amending 
  1.6             Minnesota Statutes 1994, sections 116.61, subdivision 
  1.7             1, and by adding a subdivision; and 116.64, 
  1.8             subdivision 1.  
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1994, section 116.61, 
  1.11  subdivision 1, is amended to read: 
  1.12     Subdivision 1.  [REQUIREMENT.] (a) Beginning no later than 
  1.13  July 1, 1991 Except as described in subdivision 1a, each motor 
  1.14  vehicle registered to an owner residing in the metropolitan area 
  1.15  and each motor vehicle customarily domiciled in the metropolitan 
  1.16  area but exempt from registration under section 168.012 or 
  1.17  473.448 must be inspected annually for air pollution emissions 
  1.18  as provided in sections 116.60 to 116.65. 
  1.19     (b) The inspections must take place at a public or fleet 
  1.20  inspection station.  The inspections must take place within 90 
  1.21  days prior to the registration deadline for the vehicle or, for 
  1.22  vehicles that are exempt from license fees under section 168.012 
  1.23  or 473.448, at a time set by the agency. 
  1.24     (c) The registration on a motor vehicle subject to 
  1.25  paragraph (a) may not be renewed unless the vehicle has been 
  1.26  inspected for air pollution emissions as provided in sections 
  1.27  116.60 to 116.65 and received a certificate of compliance or a 
  2.1   certificate of waiver. 
  2.2      Sec. 2.  Minnesota Statutes 1994, section 116.61, is 
  2.3   amended by adding a subdivision to read: 
  2.4      Subd. 1a.  [EXCEPTION FOR NEW VEHICLES.] A vehicle need not 
  2.5   be inspected until the year of its next registration is five 
  2.6   years more than its model year. 
  2.7      Sec. 3.  Minnesota Statutes 1994, section 116.64, 
  2.8   subdivision 1, is amended to read: 
  2.9      Subdivision 1.  [AMOUNT.] Beginning January 1, 1991 1996, 
  2.10  an annual fee established in accordance with the rules of the 
  2.11  agency, not to exceed $10 $8, is imposed for the cost of the 
  2.12  inspection of a motor vehicle at a public inspection station and 
  2.13  such reinspections as the rules of the agency allow, the cost of 
  2.14  the contract entered under section 116.62, subdivision 3, and 
  2.15  the administrative costs of the agency and the department. 
  2.16     Sec. 3.  [EFFECTIVE DATE.] 
  2.17     Sections 1 to 3 are effective January 1, 1996.
