  1.1                          A bill for an act 
  1.2             relating to underage drinking; increasing penalties 
  1.3             for a person, other than a retailer, to furnish 
  1.4             alcoholic beverages to a person under the age of 21 if 
  1.5             the underage person causes or suffers death or great 
  1.6             bodily harm as a result of intoxication; amending 
  1.7             Minnesota Statutes 1998, section 340A.701, subdivision 
  1.8             1. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1998, section 340A.701, 
  1.11  subdivision 1, is amended to read: 
  1.12     Subdivision 1.  [UNLAWFUL ACTS.] It is a felony: 
  1.13     (1) to manufacture alcoholic beverages in violation of this 
  1.14  chapter; 
  1.15     (2) to transport or import alcoholic beverages into the 
  1.16  state in violation of this chapter for purposes of resale; or 
  1.17     (3) to sell or give away for beverage purposes poisonous 
  1.18  alcohol, methyl alcohol, denatured alcohol, denaturing material, 
  1.19  or any other alcoholic substance capable of causing serious 
  1.20  physical or mental injuries to a person consuming it; or 
  1.21     (4) for a person other than a licensed retailer of 
  1.22  alcoholic beverages, a bottle club permit holder, a municipal 
  1.23  liquor store, or an employee or agent of any of these who is 
  1.24  acting within the scope of employment, to violate the provisions 
  1.25  of section 340A.503, subdivision 2, clause (1), by selling 
  1.26  alcoholic beverages if the underage purchaser of the person to 
  1.27  whom the alcoholic beverage was sold, bartered, given, or 
  2.1   furnished becomes intoxicated and causes or suffers death or 
  2.2   great bodily harm as a result of the intoxication. 
  2.3      Sec. 2.  [EFFECTIVE DATE.] 
  2.4      Section 1 is effective August 1, 1999, and applies to 
  2.5   crimes committed on or after that date.
