  1.1                          A bill for an act 
  1.2             relating to education; providing for a swimming pool 
  1.3             levy; amending Minnesota Statutes 2000, section 
  1.4             126C.45. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2000, section 126C.45, is 
  1.7   amended to read: 
  1.8      126C.45 [ICE ARENA AND SWIMMING POOL LEVY.] 
  1.9      (a) Each year, an independent school district operating and 
  1.10  maintaining an ice arena, swimming pool, or both may levy for 
  1.11  the net operational costs of the ice arena, swimming pool, or 
  1.12  both.  The levy may not exceed the net actual costs of operation 
  1.13  of the arena, swimming pool, or both for the previous year.  Net 
  1.14  actual costs are defined as operating costs less any operating 
  1.15  revenues. 
  1.16     (b) Any district operating and maintaining an ice arena, 
  1.17  swimming pool, or both must demonstrate to the satisfaction of 
  1.18  the office of monitoring in the department that the district 
  1.19  will offer equal sports opportunities for male and female 
  1.20  students to use its ice arena and swimming pool, particularly in 
  1.21  areas of access to prime practice time, team support, and 
  1.22  providing junior varsity and younger level teams for girls' 
  1.23  ice or water sports and ice or water sports offerings. 
  1.24     [EFFECTIVE DATE.] This section is effective for taxes 
  1.25  payable in 2002 and later.
