A bill for an act
relating to education; requiring schools to maintain a supply of non-patient-specific
epinephrine auto-injectors; amending Minnesota Statutes 2020, section 121A.2207.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 121A.2207, is amended to read:


121A.2207 LIFE-THREATENING ALLERGIES IN SCHOOLS; STOCK SUPPLY
OF EPINEPHRINE AUTO-INJECTORS.

Subdivision 1.

Districts and schools deleted text beginpermitteddeleted text endnew text begin requirednew text end to maintain
supply.

Notwithstanding section 151.37, districts and schools deleted text beginmaydeleted text endnew text begin must new text end obtain and possess
new text begin a minimum stock of at least two new text endepinephrine auto-injectors to be maintained and administered
by school personnel to a student or other individual if, in good faith, it is determined that
person is experiencing anaphylaxis regardless of whether the student or other individual
has a prescription for an epinephrine auto-injector. The administration of deleted text beginandeleted text endnew text begin a
non-patient-specific
new text end epinephrine auto-injector in accordance with this section is not the
practice of medicine.

Subd. 2.

Arrangements with manufacturers.

A district or school may enter into
arrangements with manufacturers of epinephrine auto-injectors to obtain epinephrine
auto-injectors at fair-market, free, or reduced pricesnew text begin, such as through the national
EpiPens4Schools program or other similar programs implemented under the School Access
to Emergency Epinephrine Act
new text end. A third party, other than a manufacturer or supplier, may
pay for a school's supply of epinephrine auto-injectors.
