A bill for an act
relating to human services; increasing the medical
assistance spenddown standard for persons who are
aged, blind, or disabled; amending Minnesota Statutes
2004, section 256B.056, subdivision 5c.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 256B.056,
subdivision 5c, is amended to read:


Subd. 5c.

Excess income standard.

(a) The excess income
standard for families with children is the standard specified in
subdivision 4.

(b) The excess income standard for a person whose
eligibility is based on blindness, disability, or age of 65 or
more years is deleted text begin 70 deleted text end new text begin 100 new text end percent of the federal poverty guidelines
for the family size. deleted text begin Effective July 1, 2002, the excess income
standard for this paragraph shall equal 75 percent of the
federal poverty guidelines.
