  1.1                          A bill for an act 
  1.2             relating to elections; establishing the voting 
  1.3             integrity and voter access account; providing for 
  1.4             funding and use of that account; appropriating money; 
  1.5             proposing coding for new law in Minnesota Statutes, 
  1.6             chapter 5. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [5.30] [VOTING INTEGRITY AND VOTER ACCESS 
  1.9   ACCOUNT.] 
  1.10     Subdivision 1.  [ESTABLISHMENT.] The voting integrity and 
  1.11  voter access account is established as an account in the state 
  1.12  treasury.  Funds received from the federal government under the 
  1.13  Help America Vote Act, Public Law 107-252, must be deposited in 
  1.14  the state treasury and credited to the voting integrity and 
  1.15  voter access account.  Funds appropriated by the legislature 
  1.16  pursuant to the matching requirement of section 253(b)(5) of the 
  1.17  Help America Vote Act, Public Law 107-252, must also be credited 
  1.18  to this account.  Notwithstanding any law to the contrary, the 
  1.19  account is defined to meet the requirements of section 254(b) of 
  1.20  the Help America Vote Act, Public Law 107-252. 
  1.21     Subd. 2.  [APPROPRIATION.] Money in the voting integrity 
  1.22  and voter access account is appropriated to the secretary of 
  1.23  state for election administration improvement purposes that are 
  1.24  consistent with the Help America Vote Act, Public Law 107-252, 
  1.25  and the state plan certified by the governor pursuant to that 
  1.26  act, and for reporting and administrative requirements under 
  2.1   that act and plan.  Federal money in this account may be carried 
  2.2   over from fiscal year to fiscal year. 
  2.3      Subd. 3.  [ACCOUNT PURPOSES.] Money in the voting integrity 
  2.4   and voter access account must be used in a manner that is 
  2.5   consistent with the maintenance of effort requirements of 
  2.6   section 254(a)(7) of the Help America Vote Act, Public Law 
  2.7   107-252.  Maintenance of effort is based on state expenditures 
  2.8   for the fiscal year ending June 30, 2000. 
  2.9      Subd. 4.  [REPORTS.] The secretary of state must send a 
  2.10  copy of the report required by section 258 of the Help America 
  2.11  Vote Act, Public Law 107-252, to the chairs of the finance 
  2.12  committees in the house of representatives and the senate having 
  2.13  jurisdiction over the budget of the office of the secretary of 
  2.14  state. 
  2.15     Subd. 5.  [LEGISLATURE NOT BOUND.] Receipt of federal funds 
  2.16  under this section does not bind the legislature to make future 
  2.17  appropriations. 
  2.18     Sec. 2.  [EFFECTIVE DATE.] 
  2.19     Section 1 is effective retroactively to the full extent 
  2.20  permitted by the Help America Vote Act, Public Law 107-252.
