  1.1                          A bill for an act 
  1.2             relating to local government; providing for tort 
  1.3             immunity for claims arising out of use or operation of 
  1.4             a recreational motor vehicle on a highway 
  1.5             right-of-way; amending Minnesota Statutes 2000, 
  1.6             section 466.03, by adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 466.03, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 22.  [HIGHWAY RIGHT-OF-WAY.] Any claim for a loss 
  1.11  involving or arising out of the use or operation of a 
  1.12  recreational motor vehicle, as defined in section 84.90, 
  1.13  subdivision 1, within the right-of-way of a road or highway as 
  1.14  defined in section 160.02, subdivision 7, or city street except 
  1.15  that the municipality is liable for conduct that would entitle a 
  1.16  trespasser to damages against a private person.
