  1.1                          A bill for an act 
  1.2             relating to state government; abolishing the 
  1.3             department of finance; transferring duties; amending 
  1.4             Minnesota Statutes 1994, section 15.06, subdivision 1; 
  1.5             Minnesota Statutes 1995 Supplement, sections 15.01; 
  1.6             and 15A.081, subdivision 1; repealing Minnesota 
  1.7             Statutes 1994, sections 16A.01, subdivisions 1, 2, and 
  1.8             3; and 16A.011, subdivisions 7 and 9. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  [TRANSFER.] 
  1.11     The duties of the commissioner of finance and the 
  1.12  department of finance are transferred to the state treasurer 
  1.13  under Minnesota Statutes, section 15.039.  Any duties previously 
  1.14  transferred from the state auditor to the commissioner or 
  1.15  department of finance are transferred to the state auditor under 
  1.16  Minnesota Statutes, section 15.039.  
  1.17     Sec. 2.  Minnesota Statutes 1995 Supplement, section 15.01, 
  1.18  is amended to read: 
  1.19     15.01 [DEPARTMENTS OF THE STATE.] 
  1.20     The following agencies are designated as the departments of 
  1.21  the state government:  the department of administration; the 
  1.22  department of agriculture; the department of commerce; the 
  1.23  department of corrections; the department of children, families, 
  1.24  and learning; the department of economic security; the 
  1.25  department of trade and economic development; the department of 
  1.26  finance; the department of health; the department of human 
  1.27  rights; the department of labor and industry; the department of 
  2.1   military affairs; the department of natural resources; the 
  2.2   department of employee relations; the department of public 
  2.3   safety; the department of public service; the department of 
  2.4   human services; the department of revenue; the department of 
  2.5   transportation; the department of veterans affairs; and their 
  2.6   successor departments. 
  2.7      Sec. 3.  Minnesota Statutes 1994, section 15.06, 
  2.8   subdivision 1, is amended to read: 
  2.9      Subdivision 1.  [APPLICABILITY.] This section applies to 
  2.10  the following departments or agencies:  the departments of 
  2.11  administration, agriculture, commerce, corrections, economic 
  2.12  security, education, employee relations, trade and economic 
  2.13  development, finance, health, human rights, labor and industry, 
  2.14  natural resources, public safety, public service, human 
  2.15  services, revenue, transportation, and veterans affairs; the 
  2.16  housing finance and pollution control agencies; the office of 
  2.17  commissioner of iron range resources and rehabilitation; the 
  2.18  bureau of mediation services; and their successor departments 
  2.19  and agencies.  The heads of the foregoing departments or 
  2.20  agencies are "commissioners." 
  2.21     Sec. 4.  Minnesota Statutes 1995 Supplement, section 
  2.22  15A.081, subdivision 1, is amended to read: 
  2.23     Subdivision 1.  [SALARY RANGES.] The governor shall set the 
  2.24  salary rate within the ranges listed below for positions 
  2.25  specified in this subdivision, upon approval of the legislative 
  2.26  coordinating commission and the legislature as provided by 
  2.27  section 3.855: 
  2.28                            Salary Range 
  2.29  $57,500-$78,500 
  2.30     Commissioner of finance; 
  2.31     Commissioner of children, families, and learning; 
  2.32     Commissioner of transportation; 
  2.33     Commissioner of human services; 
  2.34     Commissioner of revenue; 
  2.35     Commissioner of public safety; 
  2.36     Executive director, state board of investment; 
  3.1   $50,000-$67,500 
  3.2      Commissioner of administration; 
  3.3      Commissioner of agriculture; 
  3.4      Commissioner of commerce; 
  3.5      Commissioner of corrections; 
  3.6      Commissioner of economic security; 
  3.7      Commissioner of employee relations; 
  3.8      Commissioner of health; 
  3.9      Commissioner of labor and industry; 
  3.10     Commissioner of natural resources; 
  3.11     Commissioner of trade and economic development; 
  3.12     Chief administrative law judge; office of administrative 
  3.13     hearings; 
  3.14     Commissioner, pollution control agency; 
  3.15     Director, office of environmental assistance; 
  3.16     Commissioner, housing finance agency; 
  3.17     Executive director, public employees retirement 
  3.18     association; 
  3.19     Executive director, teacher's retirement association; 
  3.20     Executive director, state retirement system; 
  3.21  $42,500-$60,000 
  3.22     Commissioner of human rights; 
  3.23     Commissioner, department of public service; 
  3.24     Commissioner of veterans affairs; 
  3.25     Commissioner, bureau of mediation services; 
  3.26     Commissioner, public utilities commission; 
  3.27     Member, transportation regulation board; 
  3.28     Ombudsman for corrections; 
  3.29     Ombudsman for mental health and retardation. 
  3.30     Sec. 5.  [REVISOR INSTRUCTION.] 
  3.31     In the next and subsequent editions of Minnesota Statutes, 
  3.32  the revisor of statutes shall, as necessary to carry out section 
  3.33  1, substitute the term "state treasurer" for the terms 
  3.34  "commissioner of finance" and "department of finance," and for 
  3.35  the terms "commissioner" and "department" where these terms 
  3.36  refer to the commissioner of finance and the department of 
  4.1   finance.  If necessary, the revisor shall prepare a bill for the 
  4.2   1997 legislative session making any statutory changes as needed 
  4.3   as a result of the transfer in section 1. 
  4.4      Sec. 6.  [REPEALER.] 
  4.5      Minnesota Statutes 1994, sections 16A.01, subdivisions 1, 
  4.6   2, and 3; and 16A.011, subdivisions 7 and 9, are repealed. 
  4.7      Sec. 7.  [EFFECTIVE DATE.] 
  4.8      Sections 1 to 6 are effective July 1, 1998.
