relating to eminent domain; prohibiting use of eminent
domain in certain circumstances; proposing coding for
new law in Minnesota Statutes, chapter 469.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

DOMAIN UNDER THIS CHAPTER.

new text begin Eminent domain must not be used to acquire real property
for any purpose authorized in this chapter if the property
acquired is intended to be sold, leased, transferred, or
otherwise conveyed to a person or nongovernmental entity without
the power of eminent domain.

following final enactment and applies to eminent domain
proceedings commenced on or after the day following final
enactment.
