  1.1                          A bill for an act 
  1.2             relating to public employees; prohibiting reemployment 
  1.3             of certain early retirees; amending Minnesota Statutes 
  1.4             1994, section 356.70, by adding a subdivision. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1994, section 356.70, is 
  1.7   amended by adding a subdivision to read: 
  1.8      Subd. 3.  [REEMPLOYMENT PROHIBITED.] A public employee who 
  1.9   has retired early under the provisions of the early retirement 
  1.10  incentive in this section; a collective bargaining agreement or 
  1.11  plan under section 43A.18; Laws 1990, chapter 591, article 2, 
  1.12  section 6; Laws 1991, chapter 345, article 1, section 112; Laws 
  1.13  1993, chapter 192, section 108; Laws 1993, chapter 224, article 
  1.14  8, section 17; or any other law providing an early retirement 
  1.15  incentive may not be hired by a public employer to work as an 
  1.16  employee in a comparable position or as an independent 
  1.17  contractor with comparable duties.  
  1.18     Sec. 2.  [EFFECTIVE DATE.] 
  1.19     This act is effective the day following final enactment and 
  1.20  applies to employment agreements and independent contracts 
  1.21  entered into, renewed, or extended after that date.  An 
  1.22  employment agreement or independent contract entered into before 
  1.23  the effective date of this act may not continue beyond June 30, 
  1.24  1996.
