  1.1                          A bill for an act 
  1.2             relating to crimes; authorizing collection of 
  1.3             treatment co-pays from offenders; prohibiting certain 
  1.4             persons who have been civilly committed for sexual 
  1.5             psychopathic reasons from receiving obscene material; 
  1.6             amending Minnesota Statutes 2002, sections 241.272, by 
  1.7             adding a subdivision; 246B.04. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 241.272, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 8.  [SEX OFFENDER TREATMENT FEE.] The commissioner of 
  1.12  corrections may authorize sex offender treatment providers to 
  1.13  charge and collect treatment co-pays from all offenders in their 
  1.14  treatment program.  The amount of treatment co-pay assessed to 
  1.15  each offender is based upon a fee schedule approved by the 
  1.16  commissioner.  Fees collected under this authority are used by 
  1.17  the treatment provider to fund the cost of treatment. 
  1.18     Sec. 2.  Minnesota Statutes 2002, section 246B.04, is 
  1.19  amended to read: 
  1.20     246B.04 [RULES; EVALUATION.] 
  1.21     Subdivision 1.  [PROGRAM RULES AND EVALUATION.] The 
  1.22  commissioner of human services shall adopt rules to govern the 
  1.23  operation, maintenance, and licensure of the program established 
  1.24  at the Minnesota Sexual Psychopathic Personality Treatment 
  1.25  Center, or at any other facility operated by the commissioner, 
  1.26  for persons committed as a psychopathic personality.  The 
  2.1   commissioner shall establish an evaluation process to measure 
  2.2   outcomes and behavioral changes as a result of treatment 
  2.3   compared with incarceration without treatment, to determine the 
  2.4   value, if any, of treatment in protecting the public. 
  2.5      Subd. 2.  [BAN ON OBSCENE MATERIAL OR PORNOGRAPHIC 
  2.6   WORK.] The commissioner shall prohibit persons civilly committed 
  2.7   as sexual psychopathic personalities or sexually dangerous 
  2.8   persons under section 253B.185 from having or receiving material 
  2.9   that is obscene as defined under section 617.241, subdivision 1, 
  2.10  material that depicts sexual conduct as defined under section 
  2.11  617.241, subdivision 1, or pornographic work as defined under 
  2.12  section 617.246, subdivision 1, while receiving services in a 
  2.13  secure treatment facility operated by the Minnesota sex offender 
  2.14  program or any other facilities operated by the commissioner.
