  1.1                          A bill for an act
  1.2             relating to family law; child visitation; expanding 
  1.3             grandparent and great-grandparent visitation rights; 
  1.4             amending Minnesota Statutes 1994, section 257.022, by 
  1.5             adding a subdivision; repealing Minnesota Statutes 
  1.6             1994, section 257.022, subdivisions 1, 2, and 2a. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 257.022, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 6.  [GRANDPARENT AND GREAT-GRANDPARENT.] A 
  1.11  grandparent or great-grandparent may petition the district court 
  1.12  for reasonable visitation rights to an unmarried minor child 
  1.13  during the child's minority.  Visitation rights may be granted 
  1.14  regardless of who has custody of the child.  Visitation shall be 
  1.15  ordered if the court finds that it would be in the best 
  1.16  interests of the child and would not interfere with the 
  1.17  relationship between the child and the parent, guardian, or 
  1.18  other custodian with whom the child resides.  In addition, if a 
  1.19  child has been removed from the custody of a parent under 
  1.20  section 260.165, subdivision 1, paragraph (c), clause (2), or 
  1.21  pursuant to a disposition under section 260.191, the court shall 
  1.22  grant visitation rights to a grandparent or great-grandparent 
  1.23  only if it determines that visitation would not endanger the 
  1.24  child's physical or emotional well-being. 
  1.25     Sec. 2.  [REPEALER.] 
  1.26     Minnesota Statutes 1994, section 257.022, subdivisions 1, 
  2.1   2, and 2a, are repealed.
