A bill for an act
relating to education; requiring individualized education programs for the
2020-2021 school year.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin INDIVIDUALIZED EDUCATION PROGRAM.

new text begin (a) A school district or charter school must provide a student with a disability with
instruction and services in accordance with the student's individualized education program
regardless of whether the district provides on-site instruction, distance instruction, or hybrid
instruction that combines on-site and distance instruction.

new text begin (b) To the extent practicable, a school district or charter school must comply with all
COVID-19 prevention guidelines issued by the Department of Health when providing
students with instruction and services.

new text begin (c) At any time during the school year, a student's family may choose to have the student
participate in distance instruction for the remainder of the school semester. A school district
or charter school must offer a distance instruction model that meets the educational needs
of all students whose families choose not to receive on-site or hybrid instruction.
