  1.1                          A bill for an act 
  1.2             relating to elections; establishing the Help America 
  1.3             Vote Act account; providing for funding and use of 
  1.4             that account; appropriating money; proposing coding 
  1.5             for new law in Minnesota Statutes, chapter 5. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [5.30] [HELP AMERICA VOTE ACT ACCOUNT.] 
  1.8      Subdivision 1.  [ESTABLISHMENT.] The Help America Vote Act 
  1.9   account is established as an account in the state treasury.  
  1.10  Money received from the federal government under the Help 
  1.11  America Vote Act, Public Law 107-252, must be deposited in the 
  1.12  state treasury and credited to the account.  Money appropriated 
  1.13  from the general fund to meet the matching requirement of 
  1.14  section 253(b)(5) of the Help America Vote Act must be 
  1.15  transferred to the account.  Money earned from investing the 
  1.16  assets of the account must be credited to the account.  Money in 
  1.17  the account does not cancel but remains available until 
  1.18  expended.  The account is subject to the requirements of section 
  1.19  254(b) of the Help America Vote Act.  
  1.20     Subd. 2.  [APPROPRIATION.] Notwithstanding section 4.07, 
  1.21  money in the Help America Vote Act account may be spent only 
  1.22  pursuant to direct appropriations enacted from time to time by 
  1.23  law.  Money in the account must be spent to improve 
  1.24  administration of elections in accordance with the Help America 
  1.25  Vote Act, the state plan certified by the governor under the 
  2.1   act, and for reporting and administrative requirements under the 
  2.2   act and plan.  Money in the account must be used in a manner 
  2.3   that is consistent with the maintenance of effort requirements 
  2.4   of section 254(a)(7) of the Help America Vote Act, Public Law 
  2.5   107-252, based on the level of state expenditures for the fiscal 
  2.6   year ending June 30, 2000. 
  2.7      Sec. 2.  [APPROPRIATION.] 
  2.8      $6,500,000 is appropriated from the Help America Vote Act 
  2.9   account to the secretary of state to carry out one or more of 
  2.10  the following activities necessary to meet requirements imposed 
  2.11  by the Help America Vote Act, Public Law 107-252: 
  2.12     (1) develop the state plan required under the act; 
  2.13     (2) modify the statewide voter registration system; 
  2.14     (3) develop and administer a procedure to process 
  2.15  complaints; 
  2.16     (4) improve polling place accessibility; 
  2.17     (5) prepare training materials; 
  2.18     (6) provide assistance to persons with limited proficiency 
  2.19  in the English language; and 
  2.20     (7) train local election officials. 
  2.21     This appropriation is available until June 30, 2005. 
  2.22     Sec. 3.  [STATE MATCH PREVIOUSLY EXPENDED.] 
  2.23     $1,750,000 expended by state and local government under the 
  2.24  voting equipment grant account established by Minnesota 
  2.25  Statutes, section 204B.48, in fiscal years 2002 and 2003, was 
  2.26  money appropriated for carrying out the activities for which 
  2.27  requirements payments are made under section 251 of the Help 
  2.28  America Vote Act of 2002, Public Law 107-252, as required by 
  2.29  section 253(b)(5) of the act.  
  2.30     Sec. 4.  [EFFECTIVE DATE.] 
  2.31     Section 1 is effective retroactively to the full extent 
  2.32  permitted by the Help America Vote Act, Public Law 107-252.
